Spousal Sponsorship and Procedural letter of fairness?

Hi to all. I am a Canadian citizen who is sponsoring his wife who is from Iraq. However I was diagnosed with PTSD and some medical conditions, so I was recommended to leave the workforce and be on social assistance. So I had sent my spousal application, originally it did not pass eligibility but it went through anyways because I did a humanitarian and compassionate grounds, because I was on social assistance. The application was then received in the Jordan Visa office, in Amman. After a while I got a procedural fairness letter due to my issue of being on social assistance, my lawyer wrote the response to it but it has been slightly more than half a year I got no response. I know that the COVID-19 crisis has slowed down things and it says still in processing for the PR. So I don’t know when will I get a response or if it’s rejected then why there is no answer. Please I need help.

Have you ordered GCMS notes recently? This will give you the best idea of what is going on with the application.

I'm not sure it's possible to be successful in sponsoring (even with H&C considerations) if you are on regular social assistance. Are you still on regular social assistance now or have you moved to disability social assistance? Ideally you are now on the disability version. If not, I would definitely recommend that you work to switch yourself over in case the application is refused and you need to reapply.

None of us can tell you the status of your file. It's really impossible for us to guess. When it comes to procedureal fairness letters, it's actually extremely unusual to receive a response in 30 days. Normally it takes at least several months to get an answer.

Since you are working with a lawyer, your lawyer should be very familiar with GCMS notes and be able to assist you in requesting this information so that you can see the detailed case notes for your application and current status. You can also apply for GCMS notes on your own. Be aware that it will take a while to receive them.

I would also recommend that you or your lawyer send a case specific inquiry to the visa office to ask for status.

You may also want to consider asking your MP (member of parliament) for help. Your MP cannot change a decision or make your application be processed faster, but they may be able to inquire about status.
