Spousal Sponsorship and ODSP!

Good news guys! I got my Permanent Residencey! Thanks so much!

I have another situation that I'm unsure of. So my husband is on ODSP (Ontario Disability Support program) and working part time and he's sponsoring me as a permanent resident so he's in a legally binding agreement to provide for my basic needs.

His ODSP worker is wanting to add me to my husband's ODSP benefit unit which means that his ODSP would go up and I'd be eligible for additional medical coverage and whatnot but I'm not entirely sure if that's supposed to happen due to the sponsorship agreement as I've read that if I as a sponsored immigrant claim any form of welfare than my husband would owe it as a federal debt.

The ODSP worker said that this shouldn't be a problem because as a permanent resident I'm eligible for ODSP and also I'm also not the main recipient and they say they've asked coworkers and consulted the directives.

I'm getting mixed messages as I don't think they have a clear indication on what the directives are and I don't want to do anything wrong in regards to the sponsorship agreement or have my husband end up owing a federal debt.

I hope you guys able to help or give me some advice in regards to this!

I've also emailed my MP about this too! So yeah!

unless you are disabled you will need to find a job, so as soon as you do, they will deduct everything you earn from his disability cheque....hope this enlightens you.

I think there's a misunderstanding. I'm well aware that I have to get a job and I'm not wanting to claim disability benefits that I'm not entitled to but in Ontario when a spouse is on ODSP they can add the other spouse to their benefit unit even if they're not disabled because there's 2 people that are married and living together.

I dont care if u get a job or not, I'm saying that if they add you, it wont be under odsp, it will be under Ontario Works. A person cannot be entitled to receive odsp unless has applied through the odsp dept. So I'm giving you a heads up, when you do decide to get a job or OW forces you to get a job, they will claw back your spouses odsp.
So for example, you make $2500/month if you get a job, then his odsp pay will reduce to $0 per month - get what I'm saying? I'm trying to warn you.
Social workers are very happy to ADD you to his odsp, they are just waiting for you to get a job so they can clawback all his pay. Well its too late now, you told them you guys are married, so you have just bombed your spouse's odsp, unless you are prepared to be unemployed for the rest of your life or work cash jobs.

@Phalos

Hi Phalos,

I already got SA. I had signed the lease in March 2019 but have put address since Aug as I was moving back and forth between the two addresses.

I am not sure when I permanently moved but as per my judgment and changes on the documents (tax, license, bank account, health card etc) it was Aug.. I am worried, should I change my dates in the form will it have any consequences for the spousal case? The reason is that I am applying for citizenship so I want to be consistent however if in case I get RQ will this be an acceptable reason for putting in Aug? For the previous address, there is no lease as it belongs to my relative but I can give mail proofs and a letter from them that I was living there since day 1.

What would you advise in this scenario? I have a pretty simple case, hardly went two times out of the country for only 37 days and on the job since the next month I landed.

Thanks.

You worry too much. Use whatever address you like, change, dont change, doesn't matter. You already have SA. As long as you stay in same province, it don't make any difference.

I agree however I am about to apply for my citizenship which makes me worried. I will keep the address same history which was spousal sponsorship but the only issue is if RQ issued then they might question that you signed the lease in March why are you putting this address from Aug.

Yes, it is the same province.

Thanks.

Declaring a spouse is not optional. ODSP clawback will be based on family income. The government only provides support in very specific circumstances and you can have very little assets in order to qualify for ODSP.
