My friend would like to sponsor his USA wife to come live with him here in Canada but he has not filed taxes for the last 5 years. Says he has some "trouble" with the CRA. Is an option C absolutely necessary?

If there is no minimum income requirement for a spousal sponsorship then what is the point of the Option C?

Can he submit the application without it and work on getting it down the road when he sorts out his issues with CRA? Will CIC automatically reject sponsor without an option c?

the option c is to confirm the sponsor has not filed for bankruptcy or has used welfare. i believe the sponsor application offers an alternative if the option c isn't available. it's not wise to just ignore it, as it is a required document and CIC can consider the application incomplete with out it or the alternative. he needs to look at the application and submit the alternative they require. your friend may want to consider getting his taxes up to date before sending in the applicaiton, in case CIC ends up requiring him to submit this form during processing.

I agree, get the taxes up to date before filing.

The only alternative to an Option C/NOA is a foreign tax document for those sponsors who are living outside of Canada.

If your friend is living and working in Canada, he has no acceptable reason to not provide an Option C.

Tell him to pay CRA whatever he owes and get his taxes up to date.
 
Agree with everyone, your friend needs to get his tax situation sorted out and get an Option C. Unless he lies (which is never a good idea), he will not have a good enough reason to not be able to provide an Option C.

If he is self employed then he can submit a Financial Statement. But I believe an Option C is still required if Notice of Assessment isn't available. I might be wrong but I thought an Option C just showed whether or not you were in clear standing with CRA like having balances and nothing to do with Bankrupcy or welfare. I submitted all 3 - Notice of Assessment, Option C and Financial Assessment.
 
As far as I understand, the option C just lists all income from any sources including passive income like dividends, or earnings through interest. Still not exactly clear what the point of it is being that there is no minimum income requirement and the option C won't disclose whether or not sponsor is an undischarged bankrupt.

It tells CIC if a person has claimed welfare.

welfare can invalidate a sponsor, unless the sponsor can prove they are no longer receiving that assistance. there are people who have had to get written documents from the welfare agency noting they have not received assistance since x date. private loans, student assistant programs, and EI or other government funding that is not welfare won't. sometimes disability may affect the sponsor's eligibilty, but i think it just triggers a longer process/evaluation, not necessarily a rejection.

If a person is on welfare, they don't qualify to sponsor.

If the sponsor has recently come off of welfare, there can be a delay if their name has not been taken off of the registry; CIC puts the app on hold until the sponsor sorts that out with the province.

If CIC believes the couple will not be able to support themselves and will have to go on welfare after the process, the app will be refused.

Not an alternative But rather an explanation as to why the Option C was not included , he can show any source of income .

i believe this information is written on the checklist for the sponsor. there is definitely a line somewhere about what to do if an option C isn't available. not sure if this works for sponsors currently living/working in canada or if it's specific to sponsors living outside of canada..

It is not really the proof of income that is import. It is proof that the sponsor didn't go on welfare. An Option C would have this proof. Other documents that just show proof of income (like Notice of Assessment or T4) would not.
