Hi there,

I’m planning to send my application very soon and was wondering if you could help me. I can imagine my question might look very silly as sometimes answers are obvious but since CIC is very strict on requirements, I can’t cease to turn questions in all senses, here is my situation. I am Belgian married to a Canadian permanent resident. She will be sponsoring me. I have 3 questions:

(1) I am on a temporary permit which will expire 12-01-2015 (In a month). I am planning to choose the OUTLAND channel (PARIS office for Belgium) but will stay in the country as a visitor. I was wondering if you could explain if there was a specific request to do in order to become visitor? I’m lost as should I apply online ? Or should I 1 or 2 days before the end of my permit, go to Niagara, and do a go and get back to change my status? Is there any specific requirements to have, like supporting documentation? Or should I mention something specific like, I’m planning to stay as a visitor until reception of the PR, and update my status every 6 months? I know that sometimes they ask for flight ticket? In my case, I don’t have, I’m planning to go back 2 weeks for Christmas with my wife end of December.

(2) Im sorry but that question is kinda similar to one previously asked in this board but I was not clear with the answer provided to the other person. Since My wife is already permanent and is the sponsor. I am the sponsored and only person in the application, does she need to provide the medical? In the Appendix A: Country specific instructions, they mention: You and every family member, Spouse is a family member but she is not coming since she is already here as a permanent resident. My understanding is that since she is PR she does not need to do it, it would be only if I had dependents with me. Does that make sense?

(3) The same question concerning forms like DEPENDENTS INFORMATION (IMM 0008), or Travel history (Part of the Appendix A: Country specific instructions) where requirements are to get the SPOUSE of the member to fill out these forms. Does my spouse need to fill out this even if she is just the SPONSOR already leaving in the country with PR?

Again you have all my apologies for these questions that might look silly, I tried to find information but didn’t really clearly find it.

1. You need to apply online to extend your stay http://www.cic.gc.ca/english/visit/extend-stay.asp. State that you are applying for PR and include a copy of the PR fee receipt as proof, along with proof of finances. Don't do a border run, as you run the risk of being refused re-entry.

2. Your wife does not need to do the medical.

3. Your wife is not a dependent, nor is she required to fill out any applicant forms.
 
Thanks so much for your feedback, it helps a lot. As I said, my work permit will expire Dec 1, 2015, and I will go through the "Application to Change Conditions or Extend Your Stay in Canada as a Visitor". On CIC, I see that they mention that application needs to be done max 30 days prior expiration date so I am good. I checked the processing time for that kind of permit, inland takes around 140 days, where outland, Paris takes 9 days. I was wondering if it was allowed to apply for it from here through Paris Office. I would send the file by mail? Would that make sense? The reason why I'm trying to short the processing time is because I'm going back with her 2 weeks in Belgium mid December to see family and spend Christmas with them and I'd like to get my visitor visa all settle to avoid any issue once we'll get back in Toronto end of Dec. I'm a bit confused. Thanks in advance for your help :)

CIC suggests applying 30 days before expiry but that is not a requirement. You can apply up until the day your status expires.

No, you cannot apply through Paris.

Provided you apply for the extension before Dec 1st, you will have Implied Status after that. Your Implied Status ends when you leave Canada. Also, your extension app is basically void once you leave. You will be evaluated as a new visitor upon re-entry.
