Spousal PR in progress, applying for visitor visa

Hi,

I need some advise. My wife is from India and currently her spousal PR application is with New Delhi for a while.

I am thinking of trying the tourist visa route so that at lease she can visit Canada in the mean time.

I have few questions and appreciate any input:

a. How hard is it to do online app and can I make the app for her?

b. Showing her ties to India would be difficult as she already left the job and all. But the intent is clear that she will visit and leave on time.

c. New Delhi has her Passports already. They request them at the start of the process in India. How is this going to pan out that they have the passports already and we are applying for a visitor visa.

getting a visitor visa is hard...

If she is in India, and you sponsor her, then Visitor visa is going to be rejected 99.9%.

Think about this way, she applied for canadian residence and her intent is clear to settle in canada with you. Now her application is in process, means CIC is in process of checking if she should be there or not(due to any reasons like security, background, fake marriage they have to check). If she has no issues then they will issue her PR visa anyways in few months once they are done.

CIC is not sure at this particular point whether your wife should be in Canada or not until they are done with with all checks. So why would they issue a visitor visa to that person.

I know this waiting is so hard, but believe thats the way it is. People have to wait for 3-4 years sometimes to be with their loved ones when their case goes to interviews,rejection and appeals.

Are you already a PR? Not sure if CIC will reject if her application is still in process. Did she already get medical request in India?

Just go visit her instead, problem solved. Whether she visits you, or you visit her, it doesn't matter, flight ticket costs the same. Besides, CIC will look favorably to applicants who visit a spouse often.

Sponsoring your spouse while living in another country

If you are a Canadian citizen, you can sponsor your spouse without being in Canada but you do then have to prove that you are planning on moving to Canada when your spouse gets approved for permanent residency. Such proof can include having arranged jobs, being accepted to college, having arranged housing or letters from friends & relatives stating that they know of your plans and that you can stay with them while you look for housing etc.

If you are a PR, you must reside in Canada in order to sponsor your spouse. You can chance short vacations (remember that a Canadian vacation is generally no longer than 2 weeks) but if immigration finds out that you are not in Canada, you risk getting your application refused.


If you're a PR, don't take chances! Be patient.

I am not sure how is it like from India, but if you can prove that your wife has a permanent job or is studying in a university and get proper proof and letters from employer/university, you may get a visit visa. I have read in a few cases, where the person was able to show a very strong proof that he/she will return to their country like a professional permanent job or an on-going University/college degree/diploma, was able to get a tourist visa.
