Hello,

I've combed the forums trying to find a similar situation and haven't, I'm hoping someone has some info, as I keep getting conflicting information from the call centre.

I'm on an OWP through my spouse that will expire Aug '13. We are separated, and want to begin the divorce process. He is scheduled to go back to the States anytime from now until Aug '13. My question..Am I able to stay here and work when he leaves? Would I only need to file an extension on my existing permit, or do I need to start the process from the beginning as if I never had one? I should note, I work for a bank in a pre-management position.

I appreciate any and all responses. I'm at a loss and really want to be able to stay in Canada.
 
Between the divorce and immigration issues, I would find yourself a law firm that has lawyers specializing in both, and hire yourself a good lawyer. Good luck!
 
The only question I have is whether I need a new permit, or if I can extend my existing one.
The divorce will be handled amicably.

If your OWP was based on your spouses employment, and he leaves Canada, you OWP is not longer valid and you must stop work.
