Spousal Open Work Permit Inquiry

Good day! I am one of the temporary worker here in Canada. I just want to ask if I can apply my husband to Spousal Open Work Permit eventhough my work permit expired this December 3 but my agency submitted the new LMIA this December 1. So I am an implied status. My question is do we need to pursue the application online to VFS since I have only the letter from agency that out Work Permit is on process? Or do we need to wait for the Work Permit before submission?

Please remove your real name. Does your employer have an approved LMIA? Do you mean you applied for a new work permit? An LMIA application doesn't give you implied status. What category NOC is your job?

Our LMIA is on process and we are applied for a new work permit. I am under NOC C... Can I apply my husband for Spousal Open Work permit while my Work permit is still on process? Who’s better to apply for him? Me or him? Thank you for the help.
