Doesn't matter how comfortable and familiar his lawyer is with this type of situation. If ever a clause in IRPA/IRPR was bullet-proof and ironclad, it's Section 117(9)(d). Failure rate on appeal is 99%, pretty much.

im sorry i dint get what u just said...can u explain it in detail? or can someone else clarify it better ?

my concern here is that as of right now i just have the POF for myself. I dont mind including my wife and kid in the initial application. But if i include them in the initial application then wont i hve to show their POF also within mine? Or can i just show my POF only ?

In order for you to immigrate, you will have to show the POF for a family of three. You must include your wife and child on the initial application, though you can say they are non-accompanying. So you could then sponsor them later. However, you still have to have sufficient funds for three people, even if they do not come with you to Canada.

The government has this rule to help make sure prospective immigrants have enough money to support their families. If they did not have this rule, then many immigrants would just show POF for 1, immigrate, and then sponsor their spouse and child as a PR - and once you are a PR, you do not need POF for your spouse and child.
