Hi there,

I need to choose the best option for my case.

I'm a PR and my Partner is in Canada since 10th September with a visitor status (from visa exempted country).

The 29th November 2017, we have sent our Inland sponsorphip application to Mississauga. And I think we shouldn't receive the AOR before Mid-January 2018.

I dont' know how long the process can be with potential delays ....

That's why I want to make sure she keeps a visitor status as long as possible.

Then I have 2 options :

- Sending an application to CIC to extend her visitor status (Potential conflict with the sponsorship ?)
- Going to the border this week to exit and re-enter ( Any risk she could'nt re-enter ?)

- Yes, apply to extend her status from within Canada. No conflicts with the PR application and good insurance in case the application is returned.
- Flagpoling at the border is risky and carries a higher chance of refusal.

There is no "potential conflict"

When does her current visitor status expire?

Did you include an OWP app with your inland application?

Yes I included a OWP application.

But I made a mistake with a form for the sponsorship application, one of them has been updated 2 days after I downloaded it on cic website.... I took me a month to fill it and I didn't recheck that point before I send it to CIC :( .... so I didn't send the application with the very last version.

Even if I'm sure the application is well filled .... I'm affraid they send it back to me end of January .... This means a new submit in february, in this case the AOR won't be here before april, and OWP before June in the worst case ...

That's why I need to anticipate ....

Highly unlikely it will be returned for only one form that is only just gone out of date.

I wouldn't worry about anything yet, you can renew visitor status right to the day it expires and you should get AOR by early February. Why would you want to go to the border this week if her status is fine until March 15th?

It is way too early to apply for an extension. Wait until March.

I thought, it was less risky to flagpole before we have AOR for the application....

And easier than an application to extend her visitor visa.

But you guys are right I’m gonna wait before I try to renew her satus.

It's more risky to flagpole now, she has a valid status until March 15th, there is a chance albeit slim that they wouldn't let her back in, but a risk you don't need to take with bundles of time left on her visitor status, and most likely you will get AOR and implied OWP status well before that expires. Extending stay online is a straight forward process online in the worst case scenario you don't get AOR by March 15th.

So relax and have a good Christmas!
