Hi everyone,

My fiancée and I are getting married in the next couple of months, and I am thinking to sponsor her via inland sponsorship. I was wondering how to make sure she has legal status in Canada during the sponsorship.

My fiancée is currently studying on a study permit and she is in the middle of her program. Our financial situation changed this year, and paying the international tuition would be a possible, but an unpleasantly high expense, as we are already paying for our wedding and as our parents have some new financial concerns of their own that we better try to help them with. We both agreed that if she gets PR and then resumes studies with regular tuition fees, it would be much better for all of us.

So, I am wondering if it is possible for her to submit an “Application to Change Conditions, Extend my Stay …. as a Visitor” (IMM 5708) so that she is not required to continue studying in order to stay here legally while our sponsorship package is being processed. Has anyone ever used IMM 5708 to convert from a study permit to a visitor permit? If this is the way to go, when should we send this application – before the sponsorship, together with the sponsorship application, or after our sponsorship documents are received?

We’d appreciate any opinion or a story of a relevant experience! We really hope we could stay together and we don’t have enough confidence from reading those application guides…

i dont think a student can change status to visitor ..however um not sure ..i think anyone expert will shed some light in it ..

In my opinion, she doesn't need to convert it. If you're applying now or before 90 days after she quit studying, apply at the same time as sponsorship PR for an open work permit (OWP) for her. By applying before her status expires, she will be legally staying here.
