After evaluating all the option I felt the best thing is to apply for PRTD for my wife and son on H&C grounds, If it's get approved, then I will apply for visit visa for my younger son. if PRTD get refused, then i think thier PR gets revoked? Just want to know if IRCC gives them a chance to apeal ? will they get visit visa to canada? otherwise I have to sponsor them again, the only issue is the timeline I don't know how long it takes and I have to stay away from my kids, but this is the price I have to pay þ the past mistakes of not maintaining my PR amd residency obligation

Yes, they can appeal. At that point - depending how long the PRTD decision takes - it is possible that not appealing and go directly to sponsoring would be quicker.

Note that you cannot apply to sponsor while it is under appeal (because they would still be PRs).

I would wait and see what happens and not focus on deciding now.
 
Hello Experts, while applying PRTD wirh H&C application, can you pls provide list of documents to be enclosed? I have prepared 2 page document explaining brief background and circumstances including illness, surgeries and death of family members , shall I enclosed medical reports , hospital summary etc? Your guidance is highly appreciated
 
I returned to canada on expired PR card and staying here since past 1 year, still I don't meet residency obligation, my wife lives in india her PR card expired and she also don't meet residency obligation.
I want her to renounce her PR and I want to sponsor her , my question is can I sponsor if i don't meet residency obligation? When I submit application to sponsor her, will IRCC lookup for my Risidency obligation will procesed to revoke my PR status since I don't meet

I am now applying to sponsor my spouse and children. However, they had previously voluntarily withdrawn their own application. What challenges might I face in this new sponsorship application? Will I need to provide a detailed explanation for why they withdrew and demonstrate Humanitarian and Compassionate (H&C) grounds?

They had previously withdrawn their own application - what type of application? To become PRs? Were they declared on your own application to become a PR?

It probably isn't an issue that can just be addressed with a short letter of explanation, but I'm really not clear on circumstances.

My background is, Myself, my wife and 2 kids became Permanent Residents in April 2009. After a brief stay, we returned to India to settle business affairs, intending to return promptly. However, my severe illness in late 2009, which required a seven-month recovery, disrupted our plans. During this time in India, our third child was born in 2010.
I later applied to sponsor my family but withdrew the application upon realizing I did not meet the Residency Obligation while outside Canada, which IRCC accepted.

Consequently, we remained outside Canada from 2009 until 2023. That year, I successfully returned with my eldest child via the Buffalo border without being reported for non-compliance. I have resided in Canada, completed 2 years and renewed my PR card.

Meanwhile, my wife and one son, unable to meet the residency obligation, voluntarily renounced their PR status in 2024 and IRCC accepted under section 72.6. I am now applying to sponsor my wife and these two children for new Permanent Residency.
Now I have prepared my application, a Letter of Explanation (LOE), and all supporting documents.
Since my case is complex, I would like to ask the experts here: has anyone seen a similar case that was ultimately approved? Thank you for your kind advice

These cases are rather infrequent but ultimately - you are a PR in compliance, your spouse and one child renounced, as long as you meet other criteria for sponsorship and they to be sponsored, there's no particular issue. (I'm not sure what the LOE is for but presume it makes sense).

How long it might take - no reason to think it should be longer 'than usual', but that's still a lot of variability.

One caution: PRs may only sponsor if they are resident in Canada (short trips are ok, but not defined). Given the previous history, I'd keep your travels to the bare minimum or forego altogether.

Your spouse and children can apply for TRVs like any others, of course, although chances better if they wait until after AOR. (Any of age can apply for work permits as well once in Canada)
