Hi,

1. The notices of assessment for three consecutive years?
The requirement for my family will be(should be) around $56K (4 people) after the 30% increase.
I make every year enough to meet the limit for Jan 2014 requirement but in 2010 I made only $44K as I was on Maternity leave. Should I include my husband (I rather do this myself) or can I submit my 2013 last pay stub (will it be accepted) or is there something else I can do? Only in 2010 my income was below the requirement income and this was due to me being on Mat leave.

2. My birth certificate. Can it be translated in Poland by sworn translator and what documents do I need to bring here for the document to be accepted by the CIC?

1. You must provide CRA notcies of assessment for three years that meet the income requirements. Your choices are either to include your husband's income - or to wait until your 2013 taxes have been filed and the notice of assessment for 2013 is available before filing the application to sponsor your parents.

2. Don't know. Hopefully someone else will be able to help.
 
I believe is applying in 2014, then you will need to show LOAs for 2011, 2012 and 2013 (the 3 preceding years to date of application). I'm pretty sure 2010 income is no longer applicable to 2014 applications.

As far as waiting to receive 2013 LOA before submitting, i'm really not sure how this works. Perhaps you can send in the application with a last pay stub to show total income in 2013, and explain the LOA will be sent when taxes are filed and it becomes available. Or perhaps you could ask your employer to push your T4 statement out asap in 2014, and show that. Then do your taxes asap as well.

I am not sure about CIC's requirements exactly but I needed some documents translated for the government (not CIC) and they asked that it be translated by a sworn translator in Canada. All translators in Canada (the legal ones) are registered with the Government of Canada. Which City are you in? If in Mississauga or Toronto I can provide you with the name of a sworn polish translator I used.

As Rob_TO mentioned you will need 2011, 2012 and 2013 assessments to apply in 2014. I can only assume that a lot of the apps CIC will receive will not meet the requirement as people will apply on January 2, 2014 without their 2013 assessment due to the cap placed on parent sponsorship. So what I would advise you to do, is to file your taxes electronically on January 1, 2014 using your last paystub for the income, deductions etc. You will get a Notice of Assessment regardless. Once that is done and you get your T4 you may need to file a correction if the amounts from the last pay stub and T4 don't match. There will be no penalites to you if you file a correction later as long as the correction is done prior to the deadline for filing.

*When I was in university I worked part time in a small law firm, and they never issued a T4 to me, they actually deducted me on taxes CPP and EI but never remitted to CRA, so when I filed my taxes I used my last pay stub, CRA never had an issue with it and gave me all the credit I claimed. I can only assume they went after the employer in my case as a year later the lawyer in that law firm was disbarred and fined by the law society.

On the Form Application to Sponsor , Sponsorship Agreement and Undertaking (IMM 1344) (I know there will be new forms to complete next year) the first question is: If you are found ineligible to sponsor indicate what you want to: withdraw your sponsorship application and get your money back less $75 fees or proceed with the application for permanent residence - fee will be retained.
What should I answer? What is the difference to let them keep the fee and see if my mom can get a permanent residence status after if I will not be accepted?

I suggest if you are found ineligible to sponsor, you stop the application and get your money back. There is no chance for an applicant to be approved if sponsor is ineligible, so you would just be wasting $500 or so of fees to process then reject the application.

I believe you should only select to proceed with the app, if you are expecting the refusal and intend to appeal it on H&C grounds or something like that.

I do not see any reason why I should be refused the sponsorship but I only said that as Yr. 2014 they will only accept 5,000 application so I think that if I will not get accepted this year should I leave the money and apply for the permanent resident for my mom.

I am meeting all the new criteria (so I think) but I am just worried if I might not be among the first 5,000 application for this year.

By the way do you know when the new forms will be available? Do you know how long would it take for them to accept the 5,000 will I at least have a week or two after the program opens?

I got a question regarding the 5000 annual cap. If the cap was reached before your application is accepted, will your application be returned with refund and thus reapply each year until you get in the 5000 cap. Or will your application get put in queue for the following year 5000 cap?

CIC will return the application unprocessed.

Nobody here can answer that. Your guess is as good as anyone else.

The biggest question I would have on submitting the forms, is what to do about proof of 2013 income. CIC is only accepting official notices of assessment from the CRA, so i'm wondering if one has to actually do their 2013 taxes, and get the NOA to include it with the app. If this is the case, then most people won't be able to apply until at least a month into 2014, assuming they file taxes as soon as possible (before they even get T4 from employer).

Or could one just submit a copy of their final pay statement of 2013 from their company to show they meet the income criteria, and say they will submit the NOA when it arrives? In this case one could send the application practically on January 1, but if CIC rejects the app as incomplete due to no NOA and sends it back to you, then you may miss out on the 5000 cap.

I really don't know which is the better way... as I would be trying to do everything possible to get the app in asap when the program opens again, but wouldn't want to risk the app being returned as incomplete. Hopefully when the new instructions are released, they'll clarify this.

No one here knows.

Nothing is stopping you from calling the CIC call centre to ask if they can tell you when the forms will be available.

You'll have to keep trying until you reach the call centre when they aren't as busy. I would try calling first thing in the morning when the desk first opens.
