Hello everyone! I'd like to ask if someone can shed some light to this process- I'd like to sponsor my 7 year old daughter from the Philippines, however immigration needs her dad's approval. Her Dad and I aren't in good terms and he was not listed as the father in her birth certificate as well, so technically I am a single mother. Is there a way on bypassing her dad throughout this whole process? I have a partner now and he is thinking of legally adopting her, however we do not know if that will complicate the process further or not. Any advice? Thank you!

Under Philippine family code, the mother has 100% custody of the illegitimate child.

I'm assuming you weren't married when she was born, as the father isn't listed. As per the laws of the Philippines, the mother in that situation has full legal custody by default.

Her dad was not on her birth certificate when she was born however I married her dad years after she was born and we're now in the process of getting an annulment.

That's what I thought so too, however immigration actually declined my application to sponsor her unless her biological dad gives permission and signs the papers as well.

If you didn't submit anything, then yes, it would be refused. You need to put in the legwork to prove it to IRCC. You need to submit proof such as a copy of the laws of the Philippines regarding illegitimate children, a letter from DSWD, a legal opinion letter, proof you weren't married when the child was born etc.
