Some advise required

Hey everyone,

I have some questions that hopefully some of you can help me with..

I have a friend back in Australia who is wanting to come back to Canada to marry his girlfriend and apply for PR for Canada.

He was on a Working Holiday Visa for two years and over stayed by about 6-8 weeks last year. He went back to Aus hoping the GF will follow but she couldnt leave her work and family behind. So over the past 8 months they have had a long distance relationship.

He has booked a flight to arrive in May this year.

So my questions are:
1. What should he say at the border if he is asked why he is coming? (I know he should'nt mention he is getting married) but can he mention coming to visit GF?
2. Can he bring with him an engagement ring?
3. Will his over stay of a few months be a possible reason for no entry?
4. If he is granted a visa for a short time (due to the overstay and so quick to return after leaving) it can still be extended?

He does have a return ticket which will help I believe


From avidly reading this forum I think I know all the answers to the above, but I just want to make sure I pass on information that is correct. I know some of the people on here have been in the same or similar situations so am hoping for some feedback.

Once he is here, I will help him with the PR application. He wants to do everything proper and by the book. Just want to make sure he gets in ok.

I brought my engagement ring to Canada with me. I had all my jewelry inside a shoe... Dork like that (saved room). But I'm female so less suspicion I guess? No one went through my bags either.

He can say he's visiting the gf. Not an issue. He can even tell the IO he's trying to convince her to move to Oz!

3- Yes. If they know or he admits to an overstay he can be denied and banned for two years. Best to let sleeping dogs lie.

4 is yes as well.

That's not good. Both have the potential to be issues. Canada doesn't have strict exit control, though, so chances are, it won't come up nor will the IO suspect it.

There is a small chance it will happen though. He might want to make an emergency plan just in case.

Btw, for #4 (I was on my phone - pain in the rear to type on) he can apply. There is no guarantee he will be approved. He will have "Implied Status" while the application is in process. If he gets denied, he will need to leave asap (I think it's within 30 days).

I cannot answer the questions regarding the work visa since I've never experienced that before but I can tell you that everytime my husband (who was my boyfriend at those times) used to always tell immigration that he was visiting his girlfriend.

When he was arriving here to get married to me, he even told them that he was here to get married. I thought they would make an issue or ask more questions but they never gave him an issue and even congratulated him.

So i would say he should be honest and say he is there to visit his girlfriend.

Once he is in Canada, I can help him get his app together so Implied Status will come into play.

Im trying to help him with all scenerios that may come up when he returns... So he can be ready

I remember telling him when he overstayed that it may cause issues and to fork out the $150 to try and extend (knowing they would refuse). That way he would have been in implied status until they gave him an answer..

Hopefully he will get through without the overstay coming up!

Overstay (and illegally working) is a red flag. In addition to a return flight, he should have more documents to support his intention to leave, i.e. rent, job back in Australia and bank statement.

He needs to declare the engagement ring at the custom.
