Applying through CEC takes longer than one year, he'd have to take 2 years in university and work for 1 year but if he spends a year in unversity, it would qualify him to apply for FSW under category 3.
 
Right.. that would take far longer than I need.. plus the fact that both me and my gf have good jobs here, and I can't just give it all up for a "chance", while also risking that in the process the rules might change again and we're screwed...

If I apply now and get accepted it's different, because then I can plan the migration in a much more sensible way.. (maybe for example going myself first and getting a job and a place to leave, while she keeps her job and joins me after I do that..).

In any case I guess giving it a shot and applying including the 4131 experience can't hurt right? At wors I'd get rejected but get the refund for my fees...
 
You are right, you can give it a shot. If they refuse you, you will get a refund (eventually) :)

Since you were a PR once, please check http://www.canadainternational.gc.ca/india-inde/visas/pr_return-retour_rp.aspx?lang=eng#Travel_Doc if you are from India. I am not sure, but you may find a way.

joy4u, thanks, I checked the link, but a) I'm not from india, and b) that seems to be if you lost your card. In my case I lost the status over 20 years ago... (or rather exactly 20 years ago if the required times were the same at the time, being I returned to my country in 1986, so in 1989 I guess the 3 years out of the country were completed...).
 
Yes, a PR travel documents are for PR's who have lost their card or had it expire while they were in another country but still have their PR status and meet the residency requirements.

3 questions if you know:

1) About my 2006 TA assignment, is it correct that they actually consider more the tasks you did than the title? Because I don't know what exactly a TA (or in my case it's "AT"? as in "Assistant Teacher"?) does in Canada, but here, what I did was give classes occasionaly, manage/follow up the practical assignments of groups of students I was assigned, and grade final exams. Being that these seem to be exactly the kind of tasks listed in the NOC list, do you think this could be valid? I already got a commitment from the Head of the department to sign a letter for me confirming I was a TA and the list of things I did. Would this(in theory at least of course) qualify me?

2) While I would be applying with my GF, there i a very high chance that at some point between when I apply and when all the paperwork is done (If we get accepted of course), that we would be 3 instead of 2.... How does one manage that, in the sense of having to request paper/PR status for a baby?

3) Do you know once you get final confirmation that all the docs are ready/sent to you/whatever, and all that's left is to actually go to Canada, how much you can wait to go? i.e. the papers are valid for xxx months and if you don't land you lost it...

1. They go more by the job duties. If you can convince them that the job duties fit, you have a shot.

2. If you have a baby at some point before you go to Canada with your PR visa to land as a PR, you would have to ask to add the baby to your file. This will probably delay you by a bit. If visas had already been issued, I think you have to send the passports back and get new visas issued.

3. Yes, you get a visa that is valid for X months (usually a year from your medicals) and if you don't go to Canada to land before that time, you lose it. You can go to Canada and land and then go back but to keep your PR status, you have to spend at least 2 out of 5 years in Canada so if you are not ready to move yet, you have up to 3 years before you would lose your PR.

Regarding the Baby issue,I assume in the first part you meant not just before I go but rather if I didn't receive the Visas yet? What happens if Visas are issued, and all that is left is landing, and we go anyway asking for a visitor visa for the baby? Could that be done and request the PR status from within Canada?
 
No, if you land without adding the baby to your file, they'll see it as fraud and you will be barred from sponsoring it. Either you land before the baby is born or you have to add it before you land.
 
Ok then. In any case, I have a full year before having to go, and in the event that they take longer than that to add him/her, I guess I could go by myself and land, and come back, then my wife does the same (by herself), and worst case scenario (extremely worse case), I have up to 3 years to return. I'd assume they have to finish adding him/her by then.... :D
 
No, when you apply to add a baby to your file, they will recall your visas if you already had them issued. They will issue you, wife and baby new visas.
 
It's not always a year but if you wait until your visa is almost expired to add the baby, I am not sure what will happen. I'd say if you get the PR visas in time to land before the baby is born, you should do it.
 
Well, I don't think that's gonna happen because one of the "conditions" my wife has for us to give this a shot is to have her first baby in our home country, so she's not alone during the whole process, you know..?

So, the visas will definately (again, if they accept us of course) would come before it's born. Still doing it this way because I want to apply as soon as possible, to know if we will be accepted with what I already have, or if I must seek some other way (gather the experience elswhere, try through Quebec, etc.). So I think applying now, having the baby added will (I hope) take less time than waiting untill then to apply...
