Dear All,

I seek your valuable expert guidance.

I am in ‘live in relation’ with my Indian partner and we are PR in Saskatchewan, Canada for the past 3 years. I am continuously living in Saskatchewan for the past three years but my live in partner is not physically living in Canada. I wish to sponsor my sister in law (Real sister of my Live in partner) under SINP. Given the description of family for SINP( below), do I qualify to be her “close relative”?

“The applicant or accompanying spouse has a close relative that is a Canadian citizen or permanent resident residing in Saskatchewan. Close relatives include:

  • Parents,
  • Siblings,
  • Grandparents,
  • Aunts and uncles,
  • Nieces and nephews,
  • Cousins, and
  • Step-family members or in-laws of the same relationships.
The family members in Saskatchewan must meet the requirements as listed in the Application Guide”

Have you lived together with your live-in partner continuously (i.e. without breaks) for at least one year? Have you filed your taxes as common law?
 
Thanks for the prompt attention. No, we have not been filing joint return of income as he is in other country due to his job. Our residential lease agreement in Canada is also in our joint name. We are continuously in the relationship since 2010. We were living together till 2019 when he had to move to Australia for his job. We have two sons aged 11 and 10 years who are studying here in Canada and staying with me. He is also financially supporting the family.

So you have been filing your taxes as single?
 
Yes please.

In that case I don't see how it's possible for you to sponsor your sister in law. You've declared yourself as single in your tax returns. This means you are not in a common law relationship and also that means the sister in law isn't related to you in any way.
