Hi!

My friend is in Alberta, a single mom, her two kids are carrying their father's name. She is still under working visa, but when the time comes that she will get her PR, do you think CIC will require an approval from the ex-partner? Please note that they are not married. I am just asking this in preparation for the future..

Hi, if the father is in the children's birth certificates your friend will need him to sign notarized consent separate one for each child.
If he is not mentioned in the birth certificates , or if she already has court order giving her full custody - your friend can submit these dox when applying for kids' PR.
The consent form is called Statutory declaration from the non accommanying parent.
Is would be great if the father agrees to sign.
If he disagrees , she will have to obtain a court order from her native country substituting the dad's consent .
The courts take long time ...this is the reason which delays my PR application .

I wish your friend's ex will agree to sign! Otherwise she will have to start the court procedure as soon as possible. Good luck .

Thank you so much for the advice, I think she really has to start the court procedure as they are not in good terms. God bless!
