I recently got the provincial nomination and in the process of applying for my PR.

My spouse had a wife and child and got divorced in 2018. We got married in 2018 after the divorce. Now I am concerned about the form IMM 5406. My husband and I have two children and they are inland with us.

Should I list this "step child" in the form and how do I navigate the medical exam requirement for all listed children that are less than 21? My husband doesn't have access to this child since we got married.

How can you declare you have a wife and 2 children by mistake? Was it only on a 2018 application since he would have had to apply for other permits since then. Are they his children? Was he actually married and did he get divorced? Where are these children and woman? Did they ever apply for any Canadian visa or permit? If he declared he was married he will be expected to prove he got divorced.

I edited this post and have corrected the information.

He was actually married and was divorced prior to our getting married.

In previous applications he has mentioned this marriage and this child and had provided the court divorce decision when he applied for sowp in 2024
