I applied for EE under CEC and got ITA after the last draw.
I applied with my girlfriend as common law partner. She was working at the time, but quit her job after August 30. In our original profile, I submitted that she has a full time job. I forgot to change it after the last day she worked, and thus our profile submitted for drawing on September 7 still says she has a full time job.

Whether she has this job or not, it doesn't affect our scores in any way. It didn't add to our points as she had only worked for 3 months. The minimum Canadian work experience to be considered to any points is one year.

My question is, should we decline the ITA? My concern is, if we apply under ITA, the job letter that her former employer provided will tell that at the time of our ITA, her actual work status did not comply with what we said on the profile. I'm afraid that would amount to misrepresentation and ban us from applying in 5 years.

My other question is, if we decline our ITA, will we be considered for the next draw?

If it does not impact your score in any way and you were truthful at the time of creating your profile - go ahead and use this ITA.

You will include her start and finish dates in the profile and they can tell that she is not employed, it won't effect your application in any way.

Are you sure about this? They won't mind the fact that I could have updated our profile after August 30 but I did not?

I'm still more inclined to decline this ITA. Cause if anything goes wrong, it will take months for us to find out. But if we decline now, with a 497 score, we could probably get an ITA next round.

You have to do what you feel is best however there is no basis for decloning the ITA. Your wife's employment status had nothing to do with your points or eligibility.

If you updated the profile, you would have still got the ITA.

When you submit your application, they check the information and will recalculate the points if there are any changes, in your case the points won't change.

However, you seem fairly stressed on this point, if you have the time and it will make you more at ease, decline and accept the next one.

No need to decline. It will have no impact on your score or your eligibility. Simply provide the correct information on your eAPR, and you will be fine.

Yes, if you still meet the criteria. But there is no need.

Thank you guys. I will not decline this ITA then. I will report on this forum how it goes after application for those who are in similar situations to reference. Fingers crossed.

It may impact the score if his partner was being allocated points for skilled work experience in Canada.

We are applying under CEC. I don't know anything about skilled work experience but as far as my partner is concerned, she has none.

if your spouse quit 'before' you got ITA and on the profile she is showing as employed..there might be a discrepancy which is why you intend to decline the ITA...

however, you may just provide them with her last two paystubs and LOE stating that it was an error on your part when you submitted for draw... when you are submitting your final PR documents

not that it matters anyway as you rightly said, you didn't claim any points for her employment...as others have pointed out you are fine as it has nothing to do with your eligibility...

hope this helps
