I have Canadian PR, I stayed in Canada for 3 months while I received my PR Card. After that I moved back to US. My last three years will start from March 2013. Now, I have few concerns here.
1. After reading various posts and comments I am bit reluctant to go Canada, is it a good idea to give away my Canadian PR and continue looking for job in US.. I have not applied for Green Card yet, and I have already consumed 3 years and 6 months of my 6 years of H1 period.
2. Can I reapply for Canadian PR if let go my canadian PR? Like I never reenter Canada before my PR Card expires.
3. I am on H1 is US, which will expire in April 2013, I have not apply for Extension yet, I am in Dilemma should I continue looking for job and apply for extension, or should I quit US and go Canada.
4. If I plan to go canada then is it a good idea to Import my car to Canada, I own coupe,2011 make.

>>> You can let your PR status expire and live in US. You may also have to think in terms of non extension of H1 or delay in receiving green card. In that case it may be possible that you may have to leave USA.

2. Can I reapply for Canadian PR if let go my canadian PR? Like I never reenter Canada before my PR Card expires.
>>> You can reapply if your occupation is in list of occupation in demand. However as of now the intake of applications are stopped and the whole program of immigration has changed in favour of those people who have job offer from Canadian employers.

3. I am on H1 is US, which will expire in April 2013, I have not apply for Extension yet, I am in Dilemma should I continue looking for job and apply for extension, or should I quit US and go Canada.
>>> This is something only you can decide. If you feel that at one time the extensions of H1 is going to be declined and you would have to leave USA then moving to Canada would be better idea at this stage.

4. If I plan to go canada then is it a good idea to Import my car to Canada, I own coupe,2011 make.
>>> You can bring the car to Canada and may have to go for some changes also in the car like day time running lamp. The list of good to be brought to Canada must have been already given to Canadian customs at the time of 1st landing. If your car is in that list the you can bring it without paying custom duty.

THanks for your prompt reply
1. I am quite aware of the fact that I may not get Visa extension or may even not be able to get green card in near future. I am also aware that my H1 status would not go beyond 3 years from now, hence there are possibilities that I may end up not able to complete my GC and never return back to US after I go back for one year, following the completion of 6 years of H1 in US.
2.I see that CIC has temporary stopped accepting the files, but if they restart accepting and if you say turns out to be true then what are the chances to get job in Canada residing outside Canada?
3. I agree moving to Canada is better option at this staget, but what baffles me a lot is the employment scenario, the savings possibilities, the work culture, the professional growth, increasing number of unemployment, the taxes, the life style and various other things that gives me a reason to rate US higher than Canada.
4. I have gone through the entire import process, RIV, has beautifully explained on their site, but things what they have not mention is, the resale capabilities of the cars purchased in US? The environmental affects on the car, snow rain heat etc.? The import duty, which the site say is 5%...

Honestly for me what matters is I want to make quick money I do not care for the country....I feel that earning in US for 3 years would make up 10 years in Canada and that is where exacly I start getting baffled

Yes, you make less in Canada while paying more tax and spending more for the same things than in the US. I worked in the US for over 5 years and just recently moved to Canada for a new job. The salary increase I got from this move is not nearly enough to cover the increased cost in housing, not to mention everything else, but this is a good opportunity of career growth for me, as well as the culture of Toronto, so I am OK with it. Besides, although I don't have green card from US yet, I can still get H1B extension (because I have approved 140) if I want to return to the US, which I plan to do so 2 years from now. If your current employer had filed PERM and 140 for you got approval for 140, then you can extend your H1B indefinitely, but from what you said in your post it didn't seem to be the case, and I think the safe bet would be coming back to Canada if you don't get the extension.

So in that case let me ask you this, I still have one more year before I come to Canada, like, from March 2014 my two years start. Do you think out of your knowledge or experience it is a good idea to apply for H1 extension and get I140?

Yes but I doubt you have enough time left for the 140 thing, since you need to get perm first, which would take about a year, then 140 would take another 6 months or longer

I was told by employer who is planning to extend my H1 that it would finish up withing 6 months PERM and I140 if filed in premium. IF that is true then I can implement on what you said, else will need to find a way around.

In theory PERM can be done within 6 months, but in reality it doesn't always happen this way. To start with, you need to get prevailing wage, as well as all the advertisement requirement, which would take a good 3 -4 months if everything goes smoothly ( mine took longer than that because of layoff in my company and you can't file for PERM for 6 months if your company recently had a layoff) ; after you file PERM and don't get audited, then you could get your PERM within 3 months; however, currently about 30-40% of PERM applications get audited, which would take another 3-6 months to clear, and among those audited, around 30% or more would be denied based on DOL's stats published monthly; and if you are Indian in the IT field, the chance of getting audited/denied is a lot higher ( I am neither but I still got audited and my case was cleared after 8 months, and got my 140 approval 2 months later with premium processing, because lawyers went on vacation and didn't file it right away -- you need to factor that in as well)

But it's always good to have backup options, if I were you I'd push my employer to move quickly with the PERM filing, but at the same time look into the possibility of working in Canada. if you become a Canadian citizen, you no longer need H1B to work in the US, you can get TN visa pretty easily -- a lot of Canadian people work in my previous companies in the US with TN visa

Thanks for detailed information. I am very confused, if Canada should be the option or not. It seems that as of now pertaining to my present condition it is imperative that I act quick and which means I should choose to enter Canada at the earliest. But I am so very scared with the job scenarios and pay grade.
