We are still working on our Inland Common-law sponsorship application and will submit soon in a couple of days and due to the holidays season there could be some delays with receiving AORs,

My common-law is on PGWP (open work permit) and its expiring in first week of Feb 2026.
  • Should we include the application (imm5710) to apply for work permit and maintain her status together with our common-law sponsorship application?
  • Or submit the common-law sponsorship application first and then submit imm5710 separately without AOR to maintain her status until a decision is made on our sponsorship?

  • Or submit the common-law sponsorship application first and then submit imm5710 separately without AOR to maintain her status until a decision is made on our sponsorship?
Applying for a Canadian Open Work Permit (OWP) without an AOR (Acknowledgment of Receipt for Spousal Sponsorship) is possible for common-law partners if their current status expires soon (2 weeks or less) and they've applied for Permanent Residence (PR) under the Spouse or Common-Law Partner in Canada (SCLPC) stream, by submitting the OWP application with required docs and waiting for the AOR, or sometimes even without it, as IRCC can see the underlying PR application stage. The AOR confirms your spousal PR application is received, but you can sometimes proceed to get an OWP while waiting for this confirmation, especially if you're close to losing your current legal status.
When You Can Apply Without an AOR
  • Timing is Key: You must apply for the OWP within 2 weeks of your current permit (work, study, or temporary resident) expiring.
  • Underlying PR Application: You must have already applied for permanent residence as a spouse or common-law partner (SCLPC).
How to Do It
  1. Submit the OWP Application: Send your Open Work Permit application with all required documents, but without the AOR.
  2. Wait for the AOR (or not): Your OWP application might not be processed until the AOR arrives, but sometimes IRCC can see the PR application's progress, allowing them to issue the OWP even if you submit it later via a webform.
What is an AOR?
  • An AOR is the official confirmation from Immigration, Refugees and Citizenship Canada (IRCC) that your spousal sponsorship (PR) application package has been successfully received.
Why This Matters for Common-Law Partners
  • This process allows common-law partners to maintain legal status in Canada and continue working (via the OWP) while their spousal PR application, which takes time to process (getting an AOR can take weeks/months), moves forward.

If you are confused how SCLPC works, please consult immigration lawyer or consultant, personally this is idle for the situation as you control it rather you depend on AOR and then apply. I hope this helps :)
