sent before 27feb, processing started 9 oct 08 new rule or old rule

Dear Member,
I need your help specially from senior members, My initial application reached CIC buffalo on 4 th Feb 2008. Just before 27 Feb 2008. but around june 2008 they returned it back, saying its incomplete and they are not keeping any record of application. I completed application and sent back. Online status shows started processing on 9 OCT 2008.
i am not on new 38 list.do not have any offer letter.
I am confused how they will process my application based on new rule or old rules(before 27 feb 08).
I realy appretciate any help that what may be next for my case.

probably new rules because they didn't keep record of you.

Perhaps you should send them a letter to say that you had applied prior hand with all the copies of your old application, receipts, etc.
It might not help, but who knows, it might.

No, new rules since there was no application, ie it was incomplete so no record was kept. So the OP starts fresh.

well, I don't know the chance of success for this route and what a good lawyer can do and how much they cost.
So it would depend on your tolerance to expected benefit to cost ratio.

My Opinion? Nil chances, the OP didn't submit a complete application as per the instructions, but the it is his/her money to waste.

Sorry to be the bearer of bad News: However, this is a personal opinion!!

As Per the Ministerial List/the Magic 38 List:

OP will be assessed according to the new rules: "they are not keeping any record of application".
OP's application will be returned: "i am not on new 38 list".

OP may want to try PNP programs. OP may want to address the question directly to BCGUY for Advice.

OP able/not able to claim his money: <NOT SURE><Think it might and might not be possible>.
Since, no record.Op may write to request back money paid, as First application was not processed.
Alternatively, if he did not pay for the second application and just sent in a new one, maybe they will return application and fee. (Who Knows)
