Job Offer........
Pre-Assessed..
Hi,

I have recently received ITA on october 1st 2015 under express entry. I am on open work permit and i need know if I was working as a contractor for a duration of 1 year in canada. What should i fill in the details of EMPLOYMENT for that duration, besides this since i was self employed I dont have employer but i have filed my taxes and i also have notice of assessment from CRA.

where it asks for the name of the employer, you write "self employed." the rest is the same.

I hope you got an ITA for FSW, because self-employed experience does not count for CEC.

Under the "proof of work experience" section here,
http://www.cic.gc.ca/english/resources/tools/perm/express/intake-complete.asp

... it describes how you must document self-employment experience...

Even though you are working as an contractor but you have set defined roles & responsibilities and fixed working hours then you are NOT self-employed. Self-employed personnel are such as taxi drivers, farmers, artists, free-lance workers etc... In my case I worked as an IT contractor through an agency for a third company and paid my own taxes by registering an incorporation and filing taxes. I worked 9-5 and had set roles & responsibilities. My experience was counted towards CRS.

If you can describe more about what you do as a contractor perhaps I can shed more light on that. Hope the above info helps. :)

Hi Dilbert,

I was working as an IT contractor too for the duration of 1 year. During this time my model was similar to yours where I was involved with a consulting company based out of US but was on client location here in canada.

From the documentation perspective, is it possible to show my sole proprietorship papers, tax returns and Notice of assessment.

All these things with a self attested reference letter defining my roles and responsibilities. Or do you think anything else would also be needed for this.

I am not sure if you can report it as employee.

You cannot use it as employment. Your T2 form will give you up (employee T2 is different from self employed T2). So are pay slips. When filling your application, it will take the dates of employment.. then there are these statutory questions

1. Are you a full time student during this period
2. Are you self employed during this period.

I think some consultant misguided about using self employment as employment. Please refer to CRA guide on employee vs self employed

http://www.cra-arc.gc.ca/E/pub/tg/rc4110/rc4110-14e.pdf

"The working relationship between the payer and the worker does not present a degree of continuity, loyalty, security, subordination, or integration, all of which are generally associated with an employer-employee relationship."

I was a former IT contractor.

Also I am wondering how come the individual above was able to incorporate with SIN starting with 9?. I think he was confusing incorporation with GST/HST registration.
