I have a misdemeanor record (petit larceny) from I was 21 years old, a college student in New York. I had the records sealed and expunged last year, and it has been more than 20 years.

I am wondering since the record is now sealed,

1) Can I say ‘No’ to any arrests or any criminal offense on the immigration form?

2) If they find out I could always say I have the legal right to say no?

3) Also, do I say no criminal history at the interview?

4) Or ‘Yes’ to convicted on all forms and interviews?

The record is still shown on FBI rap sheet; however, I have the letter from NYS court stating that the record is now sealed and will not be released unless I am buying a gun or applying to be law enforcement.

How will this affect my immigration to Canada?

Does anyone have this experience? Thank you!

1. No, you can't. You have to declare that. It *did* happen.
2. This is Canadian immigration that you are applying for, not a US job....
3. Again no. You *do* have a criminal history.
4. Correct. IRCC will ask you to provide details.

If you are honest and don't try to misrepresent, it should not harm your application.

Agree with zardoz. Declare and provide all documentation up front so that IRCC doesn't have to request more info from you later.
