Hi All,

My common law partner is sponsoring me for Permanent Residency and I'm just finishing up the paperwork. I had a question i regards to the Schedule A Background Declaration.

It specifically asks for 6j, "been detained, incarcerated or put in jail?" Are they specifically referring to if you've been arrested + handcuffed?

The reason I ask is because I was recently "detained" at a roadblock in Canada for suspicion of impaired driving. I did a breathalyzer on the spot inside the police officer's car, but was not handcuffed. I blew a 0.00. I was immediately let go. I'm still legally in Canada on a work visa.

Is this something I should be mentioning on this form, or does this not count?

1. No, it doesn't have to be reported, as you were not detained or arrested.
 
Is there a more exact definition of being detained as far as the CIC is concerned? It is a bit confusing because the question mentions incarceration or serving jail time. I tried to look at any guides to get clarification of the use of the word "detained", as I was verbally told by the police officer that I was in fact being detained.

I wasn't ever under arrest or brought to the police station and left immediately. I just want to make sure I'm getting the right information. DUI checkpoints are pretty commonplace across North America and as far as I understand any time a police officer suspects you of committing a crime where an automobile is involved you are detained, and they may perform warrantless searches, request the breathalyzer test, etc. with probable cause.

I know it seems really trivial but the last thing I want to do is not mention this incident if it's required, and at the same time I don't want to delay my application any longer than it needs to be.
