Hello!

I had a few questions regarding how we should go about our application and I found this wonderful forum, hope some knowledgeable or experience individuals can help!

My fiancee and I met online through a mutual friend and have been together for 3 years long-distance. I have visited her twice and we have already started getting together pictures, chat logs, call logs, etc as proof.

I know outland conjugal is probably the best option for us, but would inland also be an option? Could she come here with a TRV and then apply for a work permit, or would she not be allowed to work until she gets approved and received pr status?

I am a Canadian citizen, we are both only 21 so I just finished school and I am working full-time and living withmy parents (where she will live as well once she arrives) Will they give me trouble over not being financially well off?

Would it be quicker to just wait out the outland even though we want to start living together as soon as possible?

Thank you in advance!

You can't do a conjugal app if she is able to travel to Canada, since there would be no barrier to living together or getting married here. IRCC does not allow conjugal apps while applicant is inside Canada.

As part of a conjugal app you need to show legal barriers to getting married or becoming common-law. So she would need to be denied a TRV to Canada, and using an OUTLAND application.

Also you need to prove the conjugal relationship itself exists. Read all the Conjugal sections in this manual: https://www.canada.ca/content/dam/ircc/migration/ircc/english/resources/manuals/op/op02-eng.pdf

Thank you! We are starting the TRV application today and I was wondering if for the proof of funds I could provide my paystubs and banking ? My fiancee is unemployed and i will be providing for her while she visits- and we will be staying with my parents rent free.

Certainly you can include an invitation letter, and that you and your family will support her financially and provide place to stay, etc while she's here.

The visa officer will also decide on the TRV based on her ties to home country, history of international travel, and how likely they feel she will return to home country once TRV is expired.

If she did get a TRV approved, you would probably want to consider marrying her in Canada and then submitting an INLAND PR app along with OWP app, all before her TRV expires. Just don't mention this in the TRV application.

If all you have otherwise is pictures and chat logs together, you may find an OUTLAND conjugal app extremely difficult to get approved. A conjugal couple should be practically marriage-like, so showing shared & joint finances, insurance, property, etc.

Thank you so much for that great info!! I thought the outland was our best option but it seems more troublesome than expected.

If they were to reject her TRV would I still be able to apply to sponsor her or would there be a pentality? (I.e cant apply for 2 years)

Edit: sorry, also if her TRV does get approved but then she gets denied the extension to stay while the inland is in process do we automatically lose the application? Would there be a pentality or ban then?

There is no penalty for a refused TRV.

If she applies inland, she can include a work permit app and/or apply to extend her visitor status. Provided she submits complete apps that aren't returned, that will maintain her status. Still no penalty or ban if she goes out of status.

No penalty for denied TRV. In fact you must show a denied TRV if you ever wanted to consider an outland conjugal app, since it shows a valid immigration barrier to come to Canada and get married here.

If she had TRV approved, as I said you would get married then apply for her PR + OWP together. Submitting the open work permit would give her implied status meaning she could stay in Canada for the entire duration her PR app is processing. In fact, she would be unable to leave Canada for all this time, for any reason, since there's no guarantee she could get back in which case any inland app would be cancelled.

What are the chances that we get approve even if we are not legally "out" to our families? We both came from a very conservative families.
