Hey all,

Wondering about whether or not the CBSA have records of returned applications. I have a feeling my application will be returned to me for a second time and if that is the case, then husband and I will be going to Canada and applying inland.

Will the border agent see that we have had returned applications? and if so, will that have a negative impact on him entering as a visitor since they will see we've tried PR?

He's a New Zealand citizen.

Returned or rejected...not the same thing

Returned. First time was for outdated forms and I've been told that it will get returned again because he didn't list me on his additional family form as his partner.

It may or may not be returned for that. Some simply have the incomplete form requested.

This will not impact his entry. There is nothing wrong with coming to Canada to apply for sponsorship, as long as the person understands that they are only entering as a visitor for now.

Ok, here's hoping they will only request it and not send it back.

I'm just concerned about them seeing previous attempts at applying, therefore they know his intentions and that he isn't really entering with the intent of a visitor, although we will only say he is visiting me. We will have proof of funds and return ticket for him but we don't know what else to show for ties to home.

I'm just unsure how dual intent works and how to prove he's visiting but also say that we are planning to apply inland PR at the same time. It'll be really bad if he gets turned away at the border, although I know that is always a risk. This whole thing makes me nervous.

They will know his intentions anyways. CBSA officers aren't stupid; when a Canadian moves back to Canada and their spouse comes along, they know that the spouse isn't planning on leaving. The point is to show CBSA that you understand he is entering as a visitor and that you are following the rules for him to live legally in Canada.

Answer the questions but don't volunteer information. He is visiting his spouse in Canada, not moving here or coming to live here. He should only have a few bags like a regular visitor. They may just wave you on through. If the officer probes further, state that you are applying for sponsorship; have the PR fee receipt and the app (if it is returned) to show as proof.

Yes, I realize that they know or assume that the spouse is planning to stay during the app process but I just don't know how to not make that part obvious to them if they want visitor intentions as well. I think I have read too many people talking about the chance of overstaying in some threads and the worry people have of being turned away for the possibility of overstaying, it's all in my head. Him being a visitor is all good, we'd apply inland + OWP later on.

Sorry, the more I think about and read the replies, the more I realize I am probably worrying too much about him being turned away for the possibility of overstaying but there is always opportunity of extending his visitor visa, isnt there?

Is there a limit to the number of times the visitor visa can be extended?

Sorry for so many questions.

You are worrying too much. It is quite rare for a person in this situation to be refused entry.

There is no set limit for visitor extensions. Many people have extended for years without issue. It doesn't really matter if you are submitting an inland app with an OWP anyways.

For now, you should stop worrying about the "what ifs" until you actually know what is happening with your current app.

Thank you and sorry for sounding like such a worrywart and asking stupid questions. I'm just trying to avoid the worst case scenario but it sounds like him getting turned away is not likely.

Thanks everyone for your replies, much appreciated.

No need to apologize, it's a stressful process.
