After graduating from University in Canada I was issued a 3 year post graduate work permit. Closer to the expiry date of my work permit, my employer at the time went through the process of applying for an LMIA with the intention of extending my work permit. The LMIA was rejected since my employer was unable to prove to Service Canada that no Canadian applicants were qualified for the position.
Shortly after, I received a letter from CIC at the end of November 2014 stating that I have 90 days to restore my status or I would have to leave Canada. I stopped working immediately once I received the later and since then I applied for some Job openings and was the successful candidate for one of the jobs. I explained to my potential employer my situation and he has gone through the process of applying for an LMIA which was only sent to Service Canada on January 19, 2014.
My question is what are the required documentation that I must submit along with the "applying to change conditions or extend your stay in Canada" application ? How can I prove to CIC that my potential employer has applied for an LMIA without a LMIA file number ? Also am I legal to remain in Canada past the 90 day grace period until a decision is made on the LMIA ?
I am a Syrian Citizen and unable to return to my home Country. In the event that the LMIA is rejected for whatever reason, can I then apply as a refugee? Or would I be forced to leave the Country upon receipt of a negative LMIA/rejection to restore my status ?
