Hi,
I was on an IEC for a year, it ended the 20th of June.
In March we sent our Application for permanent residence From inside Canada with my husband sponsoring me.
I was later informed that I need to change my status to a visitor when the IEC visa expires. On June 20th, the last day if my visa I sent the application. I'm aware that I was a bit late on this and that it was stupid of me.
Recently I got a response back from CIC asking me for the $200 fee for restoration of status. We paid it immediately. However now I am seeing from other sources that I shouldn't need the restoration as I am under implied status.

Does anyone know anything about this? If they made a mistake in asking me to restore my status and pay the fee is there any way to amend it? Or did I actually stay beyond the validity of my status by applying too late?

You and me are both in the same situation.
I only have a photocopy of it I don't remember what manual it came from but let me write it down:
In a situation where an applicant has visitor status submits an permanent residence application to Vegreville and at the same time submits an application for a work permit, the visitor may be considered to have requested an extension of their TR status. They are considered to have implied status as a visitor until their decision is made on their WP application.

When no application for a work or study permit is received with the permanent residence application, the applicant is obliged to apply to extend their visitor status.

And with work permit does applying for the OWP count or does it have to be a normal one? If it has to be a normal one then I guess everything is in order. I just hope it doesn't give me any trouble in the future!
 
My IEC visa ran out the day before we were able to send off our PR and OWP which was taking forever. So I felt obliged to go online the night before the IEC ran out to extend my stay as a visitor, and got an email confirmation just a couple minutes later. About a month later we received the extension which was only 4 months worth.. Which I found pretty peculiar since we mentioned we applied inland. So it ran out just earlier this month and I haven't done anything since then since most say that when we request an OWP with the application we didn't even need to extend? It's uber confusing.
 
That was so fast for you though! It took 2 months for me just to get the email about the restoration fee. And the call center said from here it could take 4 months but as long as I put in the application I am at least under implied status until the decision is made. We did however send off our PR application 3 months before my IEC expired.

My grasp of it was that as long as you actually had the visitor status you could ride on your implied status until the AIP, just that it didn't work for IEC.

That is odd. Very odd. I am not sure whether I should restore my visitor status that I extended back then?! Like CIC does not make this somewhat easy to understand at all. Why would they ask you to restore your status if you applied 3 months before the IEC ran out they clearly know you included an OWP with the application.
 
Wow, you both did it wrong.

You don't have to become a Visitor once you are on Implied Status you just stay on the previous work permit you was on before. Since you was on a IEC Visa and you already applied for a OWP and a In-land PR at the same time you could have still worked after you're IEC came to a end.

There was no reason to leave your job and become a visitor as you could have still continued to work under Implied Status for you're current employer.

You are so wrong. I am way done with the IEC and continuing to work deal. We did it to be safer than sorry. It's all over and done with so quit talking about it please. I don't mind discussing it but you continue to tell people. We get it.

I think the main concern here is if we should restore our status or not.
 
Regardless there is nothing achieved by telling us what we did wrong, what we need to know is how to amend or proceed.

I had border control work in the same building as me, we discussed this a lot and we often joked about them coming to take me away if I was still there when my IEC was up. I doubt me still orking there would have went over smoothly ;) and I worked at Starbucks so I saw them twice a day.

For me I already sent the applications both to extend and restore my status as a visitor. I am just interested in knowing if they were right to ask for the restoration from me or if I sent $200 down the drain and if so can I fix it somehow?

1. If your application was received after your status expired, then you require restoration.
2. By the way you are correct, IEC is not extendable, so you can't continue to work under "implied status"

You are right! Funny the person telling you that you are so wrong is the one that is wrong. On the first page of this forum there is a young lady in a world of trouble after continuing to work after IEC expired even tho PR app was submitted.

As for restoration of status, I believe you had to get the first visitor visa so you were here legally after IEC expired but I wouldn't think you would have to keep renewing it. That's only my interpretation

Hi PMM

So if we extended my stay as a visitor and got an email confirmation that they received it the day before the IEC visa ran out, and Vegreville didnt receive the PR plus OWP app until a couple days later. Then received a short 4 month extension later on which just ran out earlier this month - I'd need to restore it?

Thank you that is what i had heard about the visitor visa, So Line.a you should be fine!

And that guy comes to every thread and argues the same thing. Neither of us are willing to risk it regardless and I don't think anyone else would either!
