We applied for spousal sponsorship application in March 2018. Medical has been completed, file is currently in New Delhi. Received Pre-Arrival in March.

PA was a PR for 25 years and about 15 years ago voluntarily rescinded his PR status due to not meeting residency requirements (at the airport)

Married to a canadian citizen, now we received letter from ndvo stating there records show PA is a permanent resident. So in order to resolve residency status, they have asked to complete one of the following two options:

Request a formal determination of your status by submitting an application for Permanent Resident Travel Document. OR

Voluntarily renounce or give up PR status by filling out the appropriate forms.

Any idea which option is better. PA has always accompanied his Canadian citizen spouse while outside of Canada so either option would work. But it was our understanding that the PR was already rescinded. We even attached copies of the original landing papers plus rescinding papers with the PR application.

Just looking for anyone with experience with this and which option would be faster and if there is a benefit of going with one vs the other?

Is the rescinding paperwork actually renouncing the PR or is it just a report for residency obligation breach?

In either event, I think voluntarily renouncing is faster and easier, but you may wish to contact a lawyer about this.

Yes the rescinding papers was actually renouncing the PR. Thanks for the input.
