Residency Requirement

Hi,
We made our landing in 2018 and have not resided in Canada since then. To maintain our residency requirement we will have to stay for 2 years before 2023 and to do that we will have to move to Canada by beginning of 2021 so as to stay 2 years from 2021 to 2023.

We had plans of moving sometime this year but with the coronavirus situation it is now uncertain if we can move before beginning of 2021 and might have to delay our move by a few months. Also our child was born outside Canada after we received pr so his sponsorship is also confusing if we don't have enough time to meet residency requirement.

Is there something we can do to request cic to extend residency requirement given the current situation.

The short answer is no. There is no process for extending your residency requirement. You still have plenty of time to meet it and the COVID-19 situation is not expected to extend into 2021 at this time. Also, as a PR, you can still enter Canada even with COVID-19 ongoing.

As for your child., you will need to wait until you are in Canada to be able to submit the application to sponsor your child for PR. To bring your child with you when you travel to Canada, you will need to obtain a TRV or eTA for your child - or if those are refused, try for a TRP.

The answer is no. You must meet the residency requirement at the time you sponsor your son. If you do not meet the residency requirement, then you cannot sponsor your son. Note that you must calculate from the time you landed and became PRs - not using the expiry date on your PR card.

Yes, if your son is a US citizen, that makes entry into Canada a great deal simpler. You could all come to Canada now. So COVID-19 can't be used as an excuse for failing to meet the residency requirement.
