Hi guys, a quick question.
Will USA refuse entry to a Canadian citizen who had a previous removal order for overstaying and where a warrant was out for their arrest?. The situation has since been resolved and a grant of citizenship was granted. Can they enter USA with this past issue?. Thanks for reply.

That's totally up to CBP when the person presents themselves at the Port of Entry.

How long you did overstayed?
You know that you have a ban for many years. You should try to get a waiver before going back to the U.S. since they won't let you in.

Thanks guys for attempting to answer the query. I was told by someone today that from Canada's end the warrant has been revoked and would not show in the system, as this was the case with her before and it has never affected her crossing the border

Yes - you should expect the US will refused entry. Becoming a Canadian citizen doesn't erase or remove past records. If someone is currently inadmissible to the U.S. - then will continue to be inadmissible after the grant of citizenship.

Note that if the overstay was greater than six months, this person has a 3 year ban from the US. If the overstay was over 1 year, the ban is 10 years. This ban still applies even if that person has become a Canadian citizen. It's not advisable to travel to the U.S. while under a ban. Best case scenario you may be refused entry. Worst case, you may be held and/or the length of the ban increased.

Hello guys may I ask how will I know if I have a removal order? I am abaout to leave Canada this month and looking forward to go back. I am asking this so that I will know if I need to apply for TRP or ARC. Thanks in advance.
