relative in canada

If I have a relative who is PR of canada but does travelling to Canada often lives at the border in USA
He has submitted a copy of passport, landing paper, PR card, SIN card, health insurance paper from Ontario, bank statement, birth certificate, relationship proof as he is my son.
Will they accept all this for 5 points in relationship
He has been to canada 2 times in last 5 months but didnt stay there very long
He works in US on H1 visa
Please let me know if I can claim 5 points on this or not
If he visits there on weekends while my application is processed is that ok????
Please help

Remember, the proof of residence in Canada doesn't mean that the pax cannot travel on vacations/emergencies. It's all about a "residential tie".

Even in the last six months the pax had been abroad, say for few days to a month (generally) - that's fine.

Derry, Please show me the law where it says how many months a relative can/cannot stay outside while the applicant's application is in CIC's hand.

There's no law... It's all about understanding the facts/necessity.

The fact is that the Adaptability Point for a Canadian Relative is based on his/her ability & willingness to help the applicant in their initial settlement, both Financially, as well as Socially/Morally. That's why that point is there... & u get the benefit of having a relative present here.

So, CIC wants to know/ensure that this "relative" is actually present in Canada & is working - employed/gainfully occupied - to assist u, lest u land up for social security. Thus, the regulation is for their presence in Canada. /Period/

CIC also understand that a PR or a Citizen needs to move around - vacations, tourism, family gatherings, medical circumstance etc. So, u get a leeway against such moves. But, it also means to show/prove the Canadian Residential Ties. His/her "one leg" Must be here. U prove that - u get the point/s. Any ambiguity there - u lose it!

I am more frank and easy going with my friends living in Canada other than my sister's in laws.
why would I stay with my married sister and her in laws after reaching in Canada?
I got my own strong financial capability and experience to live alone in Canada without my married sister's help.

CIC thinks stories in their own made ways and the reality is the other way round. very funny !!
