I have a non Canadian nephew (Mexican) that I have legal custody here in Canada, he’s 16 now and he is going to high school in Alberta. Currently he’s on Visitor’s visa (august 27/21-Feb27/22) and waiting for the student visa. We are looking for ways for him to stay in Canada permanently.

-Can he do the “Registered Apprenticeship Program” now that he is doing his high school here? He would have an Equipment operator certificate. Would that help? (2 years). Can he be hired after high school and stay here?

-What other way can he stay?

-Can I adopt him?

-How much is an international adoption if I am already his guardian and he’s in Canada?

I do not know what to do.

Are his parents deceased? Usually apprenticeships are limited to those with permanent status in Canada (PR or citizen) because there is a shortage of apprenticeships. I have seen some international students secure apprenticeships. Normally they have some sort of family connection. There is usually an in class component to trades before doing the apprenticeship so he would need to get accepted to a college program first as an international student. How is he attending school without a student permit?

Is he an orphan? Are both parents deceased?

Alberta's Registered Apprenticeship Program requires all applicants to be either PRs or Citizens. So not an option for him at this time.

His father is deceased, and his mother agreed to give me the child’s custody so he could come and study high school in Canada. Mauricio is an only child. When they open the border back in August 2021 I went to Mexico and I brought his with me. I had legal notarized, translated papers granting me the custody of my nephew in Mexico. The border officer granted him access knowing that the final purpose was for him to stay with me and go to school. Once in Canada I contacted child services to get legal custody of him here and at the same time talked to the school. The school asked their lawyers and they said that for my nephew to go to school he needed the custody papers. No student visa. I told the principal that we were working on it. We haven’t received it so I am getting a bit nervous because his visitor’s visa expires Feb 27,2022. We went to talk to immigration at the airport here in Calgary and the officer we talked to said that because we got a confirmation that the government received the application for the visa he can stay until we receive an answer. looks like they are backlogged due to covid.

Now, looking into options for my nephew to stay permanently in Canada there are really not many options, specially when we are financially ok but not enough to pay the $26,000 tuition for a college or the fees for international adoption. The adoption is a new idea because I already have custody, so I am not sure if that helps for me to adopt him without all the astronomical expenses. The other idea was the apprenticeship program. His chances for him to get a job offer here with a 2 years apprenticeship during high school are much higher than with nothing. even if its a 3 years apprenticeship I would need to pay just for 1 year not 3. this is the apprenticeship at the same time than high school, not college. although that's another option... I have 2 other kids same age so all of them will be going to college more or less at the same time, they were both born in Canada so they are ok and they can get loans to go to college, and I am single mom. what other options do I have for my nephew to stay? Thanks!!
