hi everybody i m new member on this forum.my case was rejected by ottawa due to shortage of some points.i have done a appeal in the court as my friends told me to do.as there was nothing wrong in my case .so can anybody guide me that how much time it will take to finalize my case once the case go back to new visa officer. i had done my medical and landing fee was already paid.anybody have any idea about this kind of situation............thanx
 
sounds strange. you were short of points and still you believe that you file will be processed?

are you already in Canada?????? and even you got through Medical and paid fee how it became possible to you rejection after medical coz of low points .........
 
yes i m in toronto on a student visa.i have got arrange employment in my case but they have gave me points for that but later on due to buffalo closer my file got transfered to ottawa and then they didn't grant me points for aeo.my aeo was valid and genuine only thing was that company got merged so they said that u don't have valid aeo.so thats why i filed for federal court appeal....
 
they can refuse your case even after medical ... if your employe withdraw AEO.... or tells the visa officer that company is no more interested in employee....

if this is the case of merger then you should produce a letter from the company explaining the situation.... and send it with reconsideration letter....

Agreed......you should ask your company for fresh job offer and submitted accordingly if your job still ongoing .......

Same thing happen with me
I applied judicial review but I m in India right now
If judicial review come on my side
How it will take to issue visa after that

if you would win judicial review then .....then you may ask for re-medical if its expired .......if not then they may say you for further additional doc. or may issue direct Passport Request.......
 
Check out the cost of JR and realize that it takes months and months and thousandsnif dollars. IF you win the visa is given to a new visa officer for review and a new decision. The judge does not approve the visa, just determines if you have the right to a new determination. You may be much farther ahead putting together a rapid reconsideration request. Usually they will only look at the information provided in original application. That also holds for the JR.
 
my lawyer is very confident that its a mistake by the officer so he's very sure that they will try to settle the case since we filed our arguments.so if he's right than any idea that if the case go back to new visa office with a letter from court that its a error in law than how much time it will take to get the passport request from ottawa .

If your lawyer is so confident, tell him that you will pay only if he wins in Federal Court, and see what his answer is.
 
yes.he is confident but my question is if my case got settled here and goes back to ottawa again with letter from court stating the error was done in this case .
then how much time they will take as my medical is still valid and lading fee already paid.
any idea all seniors.
