I've applied for TRV online last September 6, 2015 requesting for a visitor VISA. The purpose of my stay was to visit my sister (PR in Canada) for 2 months. Today, I've received the letter of refusal stating 2 reasons - Length of Proposed Stay and "Not satisfied that I have sufficient funds to carry out the stated purpose in going to Canada or to maintain myself while in Canada and to effect my departure". In the letter, it says "You are welcome to re-apply if you feel you can respond to these concerns and can demonstrate that your situation meets the requirements. All new applications must be accompanied by a new processing fee." I need an advice on how I am going to re-appeal my TRV application.

What documents should I submit in particular to prove that I will leave Canada after the authorized stay?

Two months is a long stay. Anyone who can travel to a different country for two months doesn't have very strong ties to their home country. When you apply again, I would limit your trip to three weeks.

What evidence did you include in your original application to show that you have ties to your home country? Do you have a permanent job? Property? Other assets?
 
I've submitted the following documents:
1. Business Registration Document
2. Certificate of Employment stating my monthly income of CAD2,500 and with a permitted LEAVE OF ABSENCE for 6 months (this I think was the culprit!). I have filed a leave which was questionable.
3. Passport with a valid US VISA (with Malaysian stamped VISA and Hawaii Entry/Exit stamps) and a copy of my old passport with VISA stamps (Australia, HK, SG, Macau)

Do you think I should book my airline tickets as proof that I am returning? Anyway, if it is not approved, it is refundable though.

I am thinking if I should write an explanation that I am the only person in the family who is taking care of my parents who are both old already and that's a reason that I need to return after my authorized stay.

I would really appreciate your inputs. Thanks!
 
Here's what's written in refusal letter:

"Following an examination of your application, I am not satisfied that your application meets the requirements of the Act and Regulations for the reasons explained below. Please note that only the grounds checked off apply to the refusal of your application.

X You have not satisfied me that you would leave Canada at the end of your stay as a temporary resident. In reaching this decision, I considered several factors, including:

X Length of proposed stay in Canada


X I am not satisfied that you have sufficient funds, including income or assets, to carry out your stated purpose in going to Canada or to maintain yourself while in Canada and to effect your departure.

As Scylla has mentioned, a visit of 2 months would mean that your employment ties are not strong.


Some questions:
1. Do you own a business and are you employed as well?

2. How much finances did you show (overall situation + for the visit)? Hope none of it was borrowed/no last minute deposits in your bank account?

3. Did you submit other employment proofs: Pay stubs + Income Tax Returns?

4. Do you own property or land? Or a lease agreement in your name for the accommodation where you live?


It's not necessary to book confirmed flight tickets..... provisional tickets would be fine. If you will not lose much (refundable tickets) then you can book it.

You must leverage your previous travel/visas for the US/Australia/Singapore, etc

1. Yes, I am currently employed for 5 years now and have registered a business (for the sake of showing ties in my country of residence)
2. My sister submitted a letter of financial support and I've also submitted a Certificate of Employment stating my monthly salary.
3. I didn't submit pay stubs and Income Tax Returns.
4. I don't have any property under my name. I can request for a lease agreement to be put under my name.

I remember when I've applied for US VISA before, it was smooth sailing during my interview process because I have the confirmed flight tickets. I am planning to shorten the length of proposed stay to 3 weeks as suggested by Scylla since it is the major reason of refusal (I thought it was the red flag that CIC perceived I'm not returning after my authorized stay because my intended stay was for more than 2 months and then my Certificate of Employment was showing I'd be on leave for 6 months).

Apart from a 2 months visit, I think the key reason for refusal is you have not submitted any financial documents.


These are my suggestions....

For Your Employment Ties:
Leave approval letter (duration of visit could be 3 weeks max) + employment letter + pay stubs for the last 6 months + Income Tax Returns

If your business is not actively trading then submitting business registration documents will not help.

Active trading = company bank statements + purchase orders/works contracts + taxes filed, etc etc


For Your Financial Situation:
Bank statement + copies of financial investments (including insurance policies, pension funds, if any)

You must demonstrate that YOU have the finances for the visit..... approx CAD 1000 per week of visit + airfare is a good amount.... even though your sister will provide accommodation/travel and living expenses

Do prepare a day-by-day itinerary listing places and activities that you'd like to do during your visit.... with expense estimates.... and show you have the finances for this.


Other Ties
A lease agreement in your name will help..... along with any deposit or proofs of rent paid by cheque/bank transfers

Explanation: Your parents are dependent on you financially and for their well-being + proofs showing you/your parents live together + who will take care of your parents temporarily in your absence

Explanation: My Travel History..... brief details of visas issued + entry/exit dates for each visit + purpose of each visit + copies/scanned visas

Hi vodka_filipina,

we just submtted ours last September 12... did you submit it online or paper? we just asked for a 3-week visit, with $3000 show money in philippines and $3000 here in canada, me as a sponsor for my husband. we received 4 msgs from cic that application has been updated, but there's no update... did you also receive the same msgs before you got the refusal? thanks for the reply...

I've submitted the application online last September 6 (Sunday). For Manila office, processing time is within 8 working days before you can get a final decision or if CIC will request for additional documents. In my case, I've received the email notification yesterday, September 15.

You should log in to your MyCIC account to check for updates.
