Hello,

One of my friends applied for a spousal open work permit from Canada with the employment letter of her husband working in NOC-B category job. But today she got a refusal and the reason for refusal is "You have not provided sufficient evidence to prove that your spouse is employed in an occupation that falls within NOC A, B or O". She already provided her husband Offer letter along with 3 pay stabs. Many people got the PR who worked in the same position.

Does she need to apply for restoration within 90 days from the expiration of Temporary resident status or she need to apply again for the Work Permit with updated documents?

If She needs to apply for restoration? Could anyone please help how to apply for restoration?

Thank you so much.

She needed to provide a letter from her husband’s employer not an offer letter. Is she out of status?

Thank you for the prompt response.

Does it mean that she needs to provide a letter from her husband's employer proving that it comes under NOC B category?
Yes, she is out of status.

She will need to apply for restoration. Not sure what she was doing previously but she is restoring to visitor status. If she is working she must stop. She can apply for restoration and SOWP and the same time. There are posts that describe what should be contained in a letter about his job duties. Would search the forum. Would include when he started working and whether it is a permanent job or contract.
