February 2020 landed in Canada and was supposed to leave April 2020 (date they gave me). But the Pandemic (COVID) hits and started closing border between Canada/US on March 2020 a month before i had to leave.

So i had decided to apply for an extension. So i waited and waited for the result. I was scared to stay and keep on waiting for the result. So i left before i hit that 1 year mark in Canada. I left couple days before i hit the 1 year mark. (February 2021)

They had emailed me the result i had finally got it. March 28 but i had left Canada already they had refused my extension (not even gonna ask why they took almost a year for my result)

But now the question is... Im planning on going back in to Canada this May. As ny girlfriend is pregnant and is due sometime in May. Would they let me in? I just really want to be there when my daughter is born.

So have you applied for a visitor visa? What is your gf’s status? Are you common-law?

She is a canadian citizen. No i have not applied for a visitor. I was just gonna get a ticket and hope for the best they would let me in. I just really want to be there for when my daughter is born

How are you going to board a plane without a visa? That is not possible. You need to apply for a visitor visa. Are you common-law?

The US border was never closed you could have left in Mqrch.

I have a passport. Im a permanent resident in America. And yes im a common-law.

I had went so many times in Canada (backnforth) without a visitor visa.

What i have is a ETA visa (electronic travel authorization visa). Thats all i apply for everytime i go to Canada

How long have you lived continuously together. If you are flying you need an ETA. You most likely need written authorization to travel unless you have absolute proof you are common law (shared rental agreements, utilities, bank accounts).

You seem to have been granted only a 2 month stay because there were concerns about you not returning to the US. Overstaying this could create problems next time you try to enter Canada.

So i shouldnt even try to come back at all? But i only overstayed because i was waiting on the result of my extension. Even if i tell them i just want to be there the day my daughter is born...?

You should certainly try. I would make sure if you are given a certain amount of time to enter Canada you respect that time limit unless you have applied for sponsorship. Would bring proof of employment in the US, proof that you have the funds to support yourself, proof that you have a home in the US, even a return ticket would be helpful. You can not quarantine with a pregnant woman unless they have a basement suite where you can live independently. You will need to have a 14 day quarantine plan.

I definitely have all of those. And yes the house shes living in has a basement where i would be quarantined.

How can we prove that? We only have pictures and chat messages. We have been living together but how are we gobna prove it
You prove it through bank accounts, shared lease, utilities, shared bank accounts/credit cards. Pictures is not enough to prove common-law. How does you girlfriend file her taxes? Does she file as common law or single?
