refusal letter from the embassy

Hi,
I am Brinda from Mauritius. I had applied for permanent resident to canada since 2yrs. I had already got my approval after 6 months of my application. I was just waiting for my medical but unfortunately I had got a mail from the embassy last week that they refused my application because of file incomplete. I dn't understand how I got my file number and it's now they refused my application like this. As I know I had sent all my document they asked by my agent and everything were going well. When I had applied they only asked for IELTS, and half cash in bank and could evaluate something such as car.And I did what they asked and now they told me that I didn't submit french results, and car evalution is not included in the fund. I had also send a recommendation letter from the restaurant I worked as I had applied for cook.And they also told me that I had done only secondary school which I didn't got maximum point. They didn't award me for adaptability and employment. Please Sir tell me how an applicant could get point for adaption if we are not in the country and also the employment. Please tell me what are the chances I have for my application.I had invested a lot on it. I can't be able to invest again to re-apply.I also want to know if I it is possible to change my lawyer.Really Sir I don't understand anything what's going on.Please reply me as soon as possible before it's too late so that I could take a decision.

Hi Brinda: I am sorry to hear all the problems you are having with your application and it sounds as if you need to have a full discussion with your agent. It would also be a good idea for you to fully understand the whole application process so you can question your agent if something doesn't seem right. For example, cars cannot be included as proof of funds. You would have to sell it, deposit the proceeds in your bank account and keep the documents as proof of where the money came from.
Adaptability: these points are given if you are married, have education, work or close relatives in Canada.
Education: what education did you submit?
Employment: what proof did you submit, how many years, did the employer's reference letter include a description of all your job duties, hours of work, duration of employment, salary, etc?
On what date was your application received? That is an important factor as the rules have changed considerably over the past few years. If you can provide more details, others will be able to help with your questions, but first of all, you have to understand the application process and requirements.

Thanks for your response. I really want a help and support so has to move ahead with my file. For the education I submit my secondary certificate. I d'nt understand for the point of employment as I am still here, I was waiting to go there to search a work. I suppose all applicant of Permanent resident are the same for the employment. they had received my application on APRIL 2010. For the car evaluation it's my agent who told me that I could evaluate my car to attach with the fund because as I will get my answer I would sold it to get the money. Please just confirm me something, could I change the lawyer because I think that as professionalism the lawyer should have contact me for further filling but unfortunately not. I only get in touch with the consultant who are not here and the office here are closed because of some personal problem with the assistant. Please confirm me about changing the lawyer and after getting a refusal letter what should be done. Is there any chances that they open the file again to appeal? Is another lawyer could have in touch with my file if I accept.Please help me. I really need help.Hope I will get a positive response with my question.Thanking you in advance and for your kindness

did u get 67 points while applying ?
was ur agent professonal ?
how much did u calculate for ur secondary level study?
changing a lawer/agent doesnt reverse the case/file.sry to say frn but i dont think u got 67 points with ur secondary certificate and without aeo.sry frn if iam wrong

I don't know if my agent is professional or not I start to doubt them now. The assistant may have personal problem but what about the lawyer. I am his client I didn't hear from him concerning the case. It's me personally who had checked my file online and then I had contacted the consultant and after two days I got a mail from the embassy which had fw by the consultant.I think that if I had not checked my file and didn't know that my file had opened since 15 or 16 april and had not contacted the consultant myself may be they will let me wait until the office open.What do you think? What advise would you give me? what should I do? hi frn ,i dnt know how did u/ur consultant calculate the points with ur secondary level cerificate .u can change ur lawer/agent but i dnt think it will be any fruitfull in this stage .u can get refund if ur case didnt go for in process otherwise no. thnaks.

... Hi Brinda, there must be something wrong in ur initial stage ie while applying . U n ur consultant must b done all in confusion otherwise secondary level cerificate without aeo n adaptability wudnt b considered as a skilled worker applicant . Agent to get ur mny n to digest it can calculate the points using their trick . How much did u pay to him? Wht was the condition of payment ? If he had told u no visa no fee he can refund u if u find him. As far as the application fee is concerned , its digested by immig, it wnt b refunded after refusal.Hows ur ielts score? If u meet 67 points , u can re apply after july 1 . I dnt think u can make it even if u appeal , sry to say all above frn but its the bitter truth after having read ur story at surface level. Finally agents r vry clever fox, always waiting to trap .thanks

hi friend. thks for your support. I spent 160 thousand rupees for all. What will happen if they dn't refund. What should I do? If I re apply should I pay again. Tell me is there any possibility that I try a job there. May be that can help me. Please tell me what should I do? Thanks

this is clear case of fraud and malpractice kindly report to cic antifraud with his name and address ...regarding ur visa go through the entire process in guide E7000 and decide ur eligible r not :'( :'( :'( :'( :'( :'( :'( :'(

If you did apply for Quebec Skilled Worker, and did meet the 67 required points it shouldnt have been the way it is now. Also did you get your CSQ or an interview? Since I remember submitting my POF after I got my CSQ when I applied for Federal.

Let me know and I will try see where it went wrong.

And yes . A car is not a valid POF sadly

Also how exactly did they ask for 160k rs to start your application? that is simply too much at a very early stage of your process. Normally any consultant would take payments step by steps as you application advances through the process.

Oh man which way you guys are going and started other stories the embassy says "the file is incomplete" so means the lawyer didn't send the full documents, that's it, Brenda just go to your lawyer and check the photocopies, if something he didn't ask and never sent just get your money back

the lawyer had sent me a mail that money is not refundable as the embassy themselves had refused my file I have all my receipt sign by the agent that prove how much I had spent with them The day I applied the agent had told me that if I withdraw the application by myself I will not be refunded but if in case the application refuse by them so I will get my money back. but now in his mail he told me that he can't do anything. I am very upset I have not eaten nor sleeping well, only crying whole day it's very unfair what happening with me. and let me tell u the office here is closed since 1 month. The assistant had not even contact me that she will be not here. I dn't know where she is? if she is in mauritius or not. The agency name is international horizontal associates. The lawyer name is ken bhavskar and the consultant work with him his kashmira thaker.Please help me to get back my money because 160000 rupees is too much for me to lose. How could I check my document when the office is close. Please trace them for me. I want your help

I had not applied for quebec but for toronto. I had invest a lot on it for my kids so as they get a better life and education but look what happen. I am in a depression state. My husband try to help me but he can't and I can't handle it anymore. They had cheated me. please if you could help me for my file please help me for god sake. god bless. Friend if you could refer me to someone to check my file so please. I don;t think so that the lawyer will return my money as I dn't even know him I know only his assistant who are not here since 2 months and dn't know where she might be. All I know that all document they asked I had given. Tell me something I dn't know if it is true but I got an information that the lawyer had been revoked what does that mean. Please help me again.
