Refugee claimant rejected, I'm on removal order - CBSA Interviews delayed due to Covid

Hello I'm on removal order, I'm a failed refugee claimant. I am wondering if I can still apply for a working/study permit.

A study permit is not possible in this situation. A work permit based on a job offer / approved LMIA is also not possible. A work permit based on your refugee claimant status may be possible depending on the details of your situation. Have you appealed the decision? Can you provide more information about your current status?

With a Departure Order, you must leave Canada within 30 days after the order takes effect. Not sure you can apply for a work permit. Are you on appeal?

Hi thanks for your reply, I am out of status now, I just go to CBSA interviews monthly, I'm now looking for a lawyer for a federal court, I also want to apply for H & C grounds. I'm about to get married soon so that I can also apply for spousal sponsorship. PRRA was rejected too.

It's not a departure order yet, The CBSA officer told me that I can still apply for a work permit but I'm not sure if I can also apply for a study permit.

Again, I don't think H&C is possible for you at this time due to the 12 months rule. I think it's good you are looking for a lawyer.

If you marry a Canadian citzien or PR, then they can sponsor you for permanent residency provided they meet the sponsorship requirement. You'll want to make sure you include evidnece in that application to show the relationship is genuine.
