i'm a refugee claimant last april 2008 and i got my work permit july 2008. i married my girlfriend september and submitted sponsorship november and checked the status and it started it's process in december. will i have more hassle because i'm a refugee claimant or should i go home and do the process there. i don't mind going home cause i need to do an exam which is one day and it will make me eligible as a nurse here. for those with the same experience please let me know. positive or negative outcome. i want to have my permanent residency and my nursing registration too.. i'm just really worried this is not gonna work or something.
 
CIC is going to scrutinize whether your marriage is one of convenience (to give you status in Canada) or whether it's genuine, and although they may scrutinize you more closely because of your refugee status, they still scrutinize ALL spousal applications for the same thing. It's a little late, if you already submitted a PR application, to start thinking about whether "going home" to do the process will make things better/easier. If you filed an inland application, you really don't have the option to go home. You need to be in Canada, living with your wife in order to be approved so, if you leave Canada and can't get back in, you're PR ap is forfeited. If you filed outland you're safe to go home - it wouldn't affect processing - but there's no guaranteed you'd be able to re-enter Canada before your permanent status is issued.
 
oh everything about our relationship is legit. it's not just for convenience. she's my gf and now my wife. i was just worried if because i'm a refugee claimant that i'll have a hard time than those who aren't a refugee claimant. and i wanna know how long it's gonna take cause it's really important for me to go home but that could wait though. i just wanna get it so i can have a way better job being a nurse. anybody know the time frame? it's been in process now. i submitted it november and started in process december 2 2008.
 
rich_m0nd, I don't think Robsluv was saying your relationship isn't legit... but rather that CIC will most likely think that your marriage is one of convenience because of your refugee status. Because of this you will have to prove to them that your relationship is genuine. Gather as much proof as you can to demonstrate the validity of your relationship.

msgomez, thanks so much. i'm just worried. do you think i can send them a copy of the registration of our car? i'm also concerned about how long the process will take. has anybody have any idea? somebody said it'll be better if the application is done out of canada and it will be faster.
 
Registration of your car is a great idea... add this to all your other proof. The more proof you have the better!

I think all of us here, that are sponsoring our spouses or have sponsered our spouses have a difficult time just sitting around waiting. It's the hardest part... that being said, the length of time it takes to complete an application depends on your country of origin and where your application is being processed. Some countries take longer than others.

And most definitely yes! - it's much quicker to sponsor a spouse from abroad rather than In-Canada. Inland apps take a significant longer time.

you words just give me a smile and give me some hope. you know what bothers me is should i just drop the application and re-do the application with outside canada. see the reason is i need to complete an exam from my country to be able to register as a nurse here. i can do that on june. if i dropped the application now and start another application for out of canada then it's running and i can go home when i get a response there and just wait. i can also let go of my refugee claim. my wife started her work as a nurse and she's really getting paid good. 30 an hour to start. and i'm so jealous knowing i can do that too but i just have to go home. what do you think ms gomez?

one big issue i see in your case now you say i can go home to do my application, cic will ask you in interview you claim for refugee it means you have life threat if you have been sent to your home country.

if you go home after securing the right to be sponsored by your wife they will think you are satisfied now because finally sponsorship will get you into Canada back and your first claim was wrong in this condition it will make problems for you and you should consult any lawyer what were the reasons you claim for refugee? kindly share with us.
 
rich_m0nd, I think this is your decision to make. How long will it take you to complete your course/exam in June? If it's just an exam you have to write than I think you'll still have time to do that without forfeiting your current sponsorship application. Outland sponsorships usually take significantly longer than inland apps; and since your app began being processed in December you should be okay.

Do what you think will be best for you now and also in the long run. You might as well keep things as they are and take it from there. I'm not an expert, by any means, and I'm not entirely familiar with the exact timelines but I don't think you should withdraw your current application.

really you think so that will happen if i go? i thought that would be faster cause that happened with my uncle. after all the inland application he ended up doing outland and that worked just fine.

it's personal reason with family. just threat with family. some feud with business and everything. my mom is already here and be going to the states. my dad has been living in italy. my sister might be going here to study. although the situation is a little ok for now cause we're out of the country. there's just one thing i need to do that's why i wanna go. and i heard there's not much questioning if your application is outland.

it's just a one day exam. that's all i need to do and be able to register for the nursing here in vancouver. and i heard it's easier to do outland application and there's less hassle. i do have a lawyer. i've not talk to him about this stuff yet though. i'll talk to him and i'll let you know what i say. thanks for your help. they say outland application is faster than inland. that exam can only be taken during june and november. i just hope my wife will be really supportive about this.

i guess then your idea is right to cancel your refugee claim and give in reason that now its okay for you to go back your home country because everything gone well between your family.

as you really want to go italy and can not wait until this process completed you should also widthdraw your inland application and go home and do it there it will be a positive effect that you did not claim refugee claim just to gain the right of PR as your uncle already faced this then it should be okay but sorry friend i am not expert in it but still try to help one and another hopefully my comments make you feel good , good luck i would strongly recommend you to see a consultant or lawyer and discuss your case before its too late.

oh i'm so thankful for your replies. i'm actually really thankful that you find time to give me advise. it gives me some hope and lessen my anxiety. i'm scared that one of this day they will revoke my work permit and won't be able to work. i should go see my lawyer. i'll let you know what happens next. it's been 3 months since i sent my application. no replies yet. they say it's faster with outland application.

Whenever someone reply my questions and give time to me i feel happy too, that is why we are here to help each other and advise and comment to each other but making decision is our own choice yes i would suggest you to go and find best lawyer discuss your situation with lawyer i am sure you dont have to go away from your wife every human being has the right to live with wife and children wish you all the best and do not worry whenever i think about my case i get worried due to that worry mind stops working and we dont get anything from worry try to keep yourself busy and consider on alternative ways to be with your wife it will help and you you should remember best Helper is our Allah (God) who will findout ways which are best for us.
