Hi guys,

Pla can some pla help me out here, i am a refugee claimant in canada, here is my issue. Just for married with my Canada wife, about to apply for sponsorship with the family class we already have all the docs we need expect the marriage cert which we already applied for but few days after we got married I got the letter of notice to appear for the refugee case for next month. So I may not be submitting the file b4 the case.

So here are my worries:
1. If denied how is my chances with the sponsorship
2. How long will it take for a deportation to come through
3. Will i still be able to re-apply for work permitt as the one I have now will soon expire

Pls help me guys!

my husband was a failed refugee, we applied after he was denied

1) even if you get denied for refugee, as long as your evidence is very strong it wont hinder your chances, the only thing different is because you were a refugee they will check through the evidence more closely to make sure its real. so dont worry about that, i know alot of failed refugees that have been sponsored by their spouses :)

2) the deportation will come faster than it used to because they just changed a rule, now they only allow you to apply for praa if 12 months have past since your refusal.. and they used to allow everyone to apply. so seeing as most likely you wont get a praa. the time to deportation is shorter. once you have your hearing, they usually decide the answer that day, if not a couple days after, than they need to mail you in writting the reasons for refusal. for us this took 4 months to get to use, they usually say it takes anywhere from 3 weeks to 6 months depending on how fast the officer puts the paperwork together. its hard to say. once you receive this, i believe the next step would be the removal order. which im not sure how long they are taking to give it out now due to the changes with the praa. but anyways once you receive the removal letter usually you have 30 days to leave the country.

3)you can reapply, my husband applied for a new work permit after he was denied and he still got it approved for 1 year. although we didnt get to use it for long because the removal order came. our immigration consultant told us the work permit would get denied because of the failed refugee, but it didnt. so its possible to get it renewed. :)
unfortunatly even if you have a valid work permit they wont let you stay longer... we tried..

Thanks for ur reply, ur reply help resolve some stress but with the rules changed now, I am sure sending in my application mostly the same week I go for my hearing for the refugee case cus I am still waiting for the marriage cert which takes a month or so. And this Is my question: I get denied for the refugee, wht options do I have to appeal it, to bye time till the sponsorship comes back? And does being sponsored by once wife stop the deportation or removal order at all? Pls do u have any idea of this!

I'm not really sure of the appeal process, we didn't go through it, you would have to consult a lawyer for your options.
But if your refugee is denied, you will still be removed even if you have applied for sponsorship, they will enforce your removal and ask you to wait in your home country until the process is complete.
 
I apply Inland from calgary in the 2010 and after 10 months they transfer my case to the local office and i stiil waiting until now with no AIP

you were a refugee right?
can i ask, did you apply before your hearing date or after?
 
I apply 2 months after my Marriage and my refusal ...the cic maybe dont believe in my marriage thats why is taking so long ....
