So my story is fairly complicated, I am 19 right now and I'm two semesters into my program in a college here in Canada. My whole family's refugee claim got denied and we are going to appeal the decision. I currently work and study at the same time, if our appeal gets denied we'll have to leave the country, is there any way of staying in Canada through a student visa to finish my studies in Canada? And if so can I apply for a student visa while being in Canada or would I have to leave the country? Will I be able to work in Canada if I can get a student visa and stay in Canada? I understand my parents would to leave, but since I would apply for a student visa I would be allowed to stay? I also have to say that I am American and my parents are not, I fell as a refugee under their situation. I understand adult Americans can not apply for refugee unless it's something like a government problem. I just want to finish my studies here in Canada, nothing else. Thank you.

Assuming your refugee case is denied, you will need to leave Canada along with your parents. Once you are outside of Canada, you can try applying for a study visa. It will likely be difficult for you to be approved. To be approved, you must demonstrate that you have strong ties to your home country and no plans on remaining in Canada long term. The refugee claim will demonstrate the opposite. However you can certainly try applying and see what happens. Good luck.

Just to add... To be approved for a study visa, you will also need to demonstrate that you have sufficient funds to pay for your tuition and expenses. Foreign students pay significantly higher tuition than domestic students (you are paying the cheaper tuition rates now). This means you'll need to show a bank statement with a balance of $25K to $30K to be approved for a study visa.

Refugee claim was made when I was underage, does that give me a little bit of an advantage? And if another family maybe is willing to pay for my studies can I use him/her for this application? I also graduated high school here in Canada. And how long does this process take? Would I be able to start the next semester? (September) assuming I get deported in May.

It's very possible CIC will still hold the refugee claim against you even though it was your parents who filed. Keep in mind you still have the issue of demonstrating ties to your home country and proving you have no intention of remaining in Canada long term. I don't see how you are going to do that given how long you have been in Canada.

If you have a close family member who is willing to sponsor your studies - then yes, this should work from a money perspective. A friend won't. The family member will have to provide their bank statement to demonstrate they have sufficient funds and should also provide an affidavit stating they are willing to support you.

I still think it's an extremely long shot. Finishing your studies in the US where you have citizenship may be far more realistic.
