Hi everyone
I'm asking on someone's behalf.
Her husband applied for Canadian immigration 5 years back and at that time he was unmarried. During this process he got married and didn't update his martial status with the IRCC. Moving on, earlier this year he got his PR. Now he wants to apply for a spouse visa but couldn't because of non-updation of results as his status with IRCC is single. Also, the marriage has been registered in Pakistan's Union Council before the arrival date of husband's visa. Is there any way she could travel to Canada? Can she apply for study visa or work visa based on her father record rather than husband?

I would appreciate it if you people could suggest something in this matter

Her husband can never sponsor her for PR.

She can certainly try coming to Canada on a study permit or work permit. To come on a work permit, she will need to secure a job offer and approved LMIA from an employer in Canada.

In terms of getting PR, she will need to qualify and apply on her own through an economic immigration program like Express Entry.

There is no "spouse visa" but since your Friend didn't declare and include his spouse in his application before he landed as a PR, he can NEVER sponsor his spouse.

The spouse will need to apply on her own (not by her father) to study or work in Canada and immigrate with her own eduction, work experience and qualification.

It's seriouse. Not a casual forgot to update situation.

And for the spouse, when she apply for her visitor, student visa, work permit ...etc she needs to be trueful and state that she is married to a PR.
She should not lie about her marital status.

Is she declares that she is married to a PR during her process, will it effect the husband's PR? Will it be canceled? Does he have to face any serious consequences for not declaring the status beforehand ?

I have no clue about it as such. What if she doesn't declare her spouse details ? Cause spouse already has a PR ? And that her financial support or who will be bearing expenses till she is able to will be by her father!

Applying through such programs, does she need to declare her martial status ? What if after declaration her husband's PR get cancelled?
