Hello,

I will be landed over the next several weeks, my application has been completed and I have my appt with CIC to get my PR card.

I was rehabilitated from a driving offense in the US.

Is that offense on record here in Canada, will it show on my driving abstract here in a background check?

Will this offense show when seeking employment which requires a background check?

I would expect it would show on your driving abstract from the US if the offense was in that state, yes. It is not "on record" in Canada, and since you were rehabilitated it won't generally show up in a CBSA check. But if someone pulls a US background check on you, yes it would show up. The rehabilitation only applies to Canada, not to the US.

An employer would have to pull a US background check to find it.

I was questioning whether my driving offense was magically "transferred" to my Canadian driver's abstract - for insurance purposes and the like.

So by providing my offense info to CIC, they wouldn't share that information with, say, RCMP? My (old?) profession requires criminal background checks because it is based in "populations at risk" for physical, emotional" abuse. I am required to become certified/registered with a professional "college" to continue working in the field. I was wondering when a background check was rum on me whether that would show in a Canadian record. I suppose they may/could run a check on my US history for criminality.

Oh heavens no. CIC has to get your permission to share your information with just about anyone. They certainly wouldn't share that sort of information with RCMP or CSIS - but those agencies have data sharing agreements with their US counterparts. Even there, a Canadian organization requesting that information isn't going to get it from RCMP or CSIS.

This is the Privacy Act: http://laws-lois.justice.gc.ca/eng/acts/P-21/index.html

Basically, they are very restricted in what they can do. They DO exchange information with the US (and UK and Australia) but that information cannot in turn be shared outward without your permission.

Thanks. It was a long, hard fight. It's also why I know a bit about the Privacy Act - I investigated the release of certain information (allegedly under the litigation exception, but it was unrelated.)

I love Vancouver! I would move there in a heartbeat, if I could find employment.
