My husband applied for a visitors visa to go to his step sons wedding and he received a misrepresentation letter saying that they weren't satisfied that he wasn't honest about being denied a visa to the states and that he was never charged with a crime. We sent a response immediately explaining the misrepresentation. What is the typical wait time for a response. We live in Jamaica and requested a 3 week visit for him. He does have 1 charge on his record in the u s in 2011. He was deported in 2012 back to Jamaica. In the reponse email we explained the when where and why of the situation. We are not sure what to expect. Time is of the essence as my son is getting married in august..Any suggestions would be appreciated

Well its unfortunate that your husband has committed misrepresentation. Hopefully your explanation and supporting documents is strong enough to convince the VO to not ban your husband for 5 years entry into Canada. It will probably take longer to process as usual due to the misrepresentation investigation

thanks for your reply. Actually the lady that filled out his forms lied on the application twice. He was totally honest with her but for some reason she answered two questions wrong. Foolishy when we went back to sign documents he didn't even read them because already had a sit down conversation with her.She knew everything . ugh so frustrating

Rule of thumb is to read everything before you sign anything. Nothing you can do now except wait and hope for the best.

You may have a chance to overturn the misrepresentation without a ban, but the visa will be denied. Unfortunately, it doesn't matter who filled out the forms, it's your responsibility to make sure they are correct. Tough I know. If you know for certain they deliberately lied on the application, report them to the CIC, as there are too many agents that do that now. Next time, apply yourself through the website.

It doesn't matter who filled the forms. IRCC expects the truth to be declared in those forms. Unfortunately, he should have checked the forms before signing them.

Worst case scenario, your husband can expect a 5-years' ban for misrepresentation plus a TRV refusal.... best case scenario, his TRV would be refused. Based on what we've seen on here, a ban is more likely

thanks Russ for your comment.. i'm from nfld too desparate to get back home for a visit.. want my husband to come with me

What charge does he have from 2011? It's possible he may be inadmissible to Canada at this time and he may have to go through the rehabilitation process before he's able to apply for a TRV to enter Canada.
