Hi,
My sister has applied for Visitor visa from India to stay with me in Canada for a month duration only, however her visitor visa got rejected with no reasons mentioned.
She is working in Delhi and had submitted all the relevant documents like :
1. Her Employment Letter
2. NOC Letter from Employer
3. Bank Statements and Pay Stubs
4. Sponsorship Letter from my side ( I am a PR holder).

Don’t know what and where it went wrong. Can we re apply for visa ? Just to make sure she has no intentions to stay or settled with me in future, her trip will be completely leisure and touring one to Canada.
I am not sure how should I convince Canadian Visa Office about this situation.
Please suggest me .

Thanks,
Nidhi

The refusal letter must have the reasons checked. Which ones were checked?

1. What was the purpose of her visit?

2. Since how long has she been working?

3. Does she have a lease in her name? Or property ownership? Or a loan or maybe mortgage?

4. Has she traveled to other countries such as the US, UK, Schengen, Australia, NZ, etc?

5. Did she prove she has adequate finances to afford the visit and airfare without depending on you nor borrowing from anyone?

6. Is she married, has children or lives with other family members who are dependent on her?

What was the purpose of her visit?
- I have applied her Visa along with my Mother and Father in the same sponsorship letter, my patent visa got accepted but unfortunately my sister’s wasn’t. Purpose of visit was family re union and tourism which was mentioned in the letter.

- She has been working almost 4-5 years now.

- She doesn’t have any lease or property ownership or mortgage on her name.

- She hasn’t travelled to any other country, this would have been her first international travel.

- Yes, she has shown enough finances in her bank supporting her expenses and stay in Canada for a month around CAD $ 8000 ( although I was responsible for her expenses and stay in Canada).

- She is unmarried.

Is there any way or situation where I can call her or meet her where our motive is just re union of the family?
Please suggest

1. Your sister must email the visa office to request them for the refusal reasons. Or else, order GCMS notes

2. Can she prove she has compelling reasons to return to her home country at the end of her visit?

3. Was any of the money in her bank account borrowed or transferred from another account?

4. Does she have any financial investments?

5. Did you include any evidence for the family reunion event?

Did you apply for an eTA (Electronic Travel Authorization) or for a TRV?

Do you hold a passport of a visa-exempt country?

- Thanks, will ask her to request one to know the reason.

2. Can she prove she has compelling reasons to return to her home country at the end of her visit?

- Reasons we stated for her returns to Home Country, India was my sponsorship letter where I mentioned she will be returning back after her stay gets over and she had submitted her NOC from Employer writing she will be joining back in the office after 25 days on X date and her vacation leave are only 25 days.

3. Was any of the money in her bank account borrowed or transferred from another account?
- Yes , she did transfer money from my father ‘s account to herself for visa processing as she doesn’t had enough bank balance.

4. Does she have any financial investments?

- Not much.

5. Did you include any evidence for the family reunion event?

- No , I didn’t as it was informal one so didn’t mention anything in the sponsorship letter sent to invite my parents and sister from India.

Any chances if she can travel to Canada in such situations for a month duration only ? Can we apply study permit visa for her mentioning that she will be applying for any short term professional course without enrolling in the college? Or do we need to get a invite from college in such cases?

Thanks for you reply.

I'm guessing your sister was refused for a number of reasons: Travel History + Purpose of Visit + Employment prospects in the home country + Financial situation.

But, do ask the visa office for the refusal reasons.

Unless she works in highly skilled work and/or has critical work responsibilities, her employment ties are not strong. This can be indirectly induced from the income earned too.

4. Does she have any financial investments?

- Not much.
A weak financial situation indicates weak employment ties + the possibility to overstay the visit.

A study permit application is completely different from a TRV. For that, she must be accepted by a Designated Learning Institution (DLI), have proof of funds to cover tuition fees and living expenses, the course must be a progression of her previous qualifications and/or work experience, etc etc.

For short courses (less than 6 months), a study permit is not required

Thank you for your replies, it does makes sense to me.
