Really Confused... Help

Hi all,

I've searched high & low for the info below but I'm really struggling to get a definitive answer. Hopefully there is a genius out there who can help.

My wife is Canadian & I'm British. We are looking to emigrate to Canada in 2015 (back home for her). We live in the UK, have a 2 year old son & another baby on the way, due October. We have completed all immigration forms including sponsorship (her) & application (me). We have included our 2 year old on all applications.

Questions:
1. Does our 2 year old need to go through the same process as me. i.e. needs to be sponsored by his mother & have a medical etc?
2. What do we do about the unborn baby? Answers vary on this forum.

Would really appreciate any help.

The child should be a Canadian citizen (providing your spouse was either born in Canada or is a naturalized Canadian). So you should list the child, but no need to actually sponsor him. Then go about getting his certificate of citizenship, and eventually Canadian passport.
The unborn baby, nothing yet. When the baby is born, notify the VO, you might need to update some forms, but otherwise, nothing changes since the baby should be a Canadian citizen as well.

1. it depends on how your wife received her canadian citizenship. By birth or through parental descent?

2. an unborn child is not included on the application. It is not necessary to tell CIC about the baby until it is born. How you notify them again depends on how your wife obtained her citizenship.

If your wife is a natural born canadian, her children are canadian and they do not need to be sponsored to live in canada. you would need to apply for their canadian citizenship certificates to prove they are canadian citizens.

Presumably that means then it is only me that needs a medical as well & the kids can will just need to apply for citizenship?

That's correct, you're the only one needing a medical exam. As for the children, your wife needs to apply for their "Proof of citizenship Certificate" at the London embassy (since you live in UK), and consequently, their passport. The processing time is about 6 months, based on a complete package. You can get started here: http://www.cic.gc.ca/english/citizenship/proof-how.asp

Your 2 year old, needs to be mentioned on form IMM5406 (applicant) and form IMM5540 (sponsor, question 15). When your second child will be born, notify the VO processing your application (London) and they will send you further instructions (most likely you will need to update the aforementioned forms). They will also probably ask for your children's proof of citizenship.
