re - entry to canda urgent

Hiii,

I am on open work permit here and even my student visa is valid till april 2013 and i am going to india in nov and coming back in feb is it okk to travel??? also i am going to apply for inland spousal application now.. but i am so confused because some people say that after applying you can't go outside canada. if anyone can help on this?? can i go n re-enter canada on my student visa as my studies are finished in april 2012 but i have my visa till april 2013....

It's not recommended because if you are denied re-entry for any reason, your application is considered abandoned.

actually my student visa is multiple soo they will not allow me to enter canada??? n even my husband is going with me i am so confused that i should leave or not?? our lawyer said thats its okk to go to india n come back but me still confused??

Technically you can leave whenever you want. It's not about leaving. It's about re-entry.

Ask your lawyer if he has a plan in place to assure your application won't be abandoned if you are refused. If he's a good lawyer, he will know what to do.

Nothing aside from a PR card or citizenship guarantees you re-entry into Canada. Your visa will help, but if the officer feels you may overstay, you can be denied entry.

Personally, I don't think you have much to worry about. It's just best to prepare for anything. Make sure to have all your documents in order and have your husband deal with immigration.

Thanks a lot for ur help!!!!! i was so worried but nw feeling kk even i talk to my lawyer today he said if i don't get the re-entry then he will apply for the spousal outside. because its really urgent for me to go to india. now i just hope they allow me to re-enter.

Just so you understand, once they start processing your application, they won't return your fees if you cancel the application and change to Outside Canada. If you're traveling after you've received Stage 1 approval, you may be past the point of no return.

I personally wouldn't be happy with your lawyer's answer. One cannot simply change an application from Inland to Outland. You have to reapply - start all over again.
