I requested Buffalo to withdraw my application 2 weeks ago. This application was sent to them in April/09 and after the new rules. The reason I want to withdraw because I entered in the US with a tourist visa of 6 months. Now, I want to re-apply but I have to wait for the withdrawal confirmation. Since it might take too long for them to confirm, WOuld it work if I send another application to Sydney and also a cover letter that I have requested Buffalo to withdraw my old one?

Yes, you can. You do not even need to withdraw if the former application was made before the new rules came into effect.

That's the problem: I applied after the new rules came in effect. Do you think I can still re-applying even though I have not gotten the withdrawal confirmation?

8) Can applicants have both a pre-C-50 FSW application and a C-50 application?

Yes, applicants may have multiple FSW applications. The applicant can choose to either maintain the first application and submit a new C-50 application with a new processing fee; or withdraw the first application and submit a C-50 application. If an applicant chooses to withdraw their pre-C-50 application before processing begins, they will receive a refund.

Missions should inform applicants that they cannot advise whether the original FSW application or the C-50 application will be a faster process. Missions should avoid recommending a particular course of action to applicants.

I got it. In item 8 states both pre C-50 and C-50. Since both are FSW application and even though my first application is no a pre C-50 but an actually C-50 because I applied after new rules, it will not matter. They see them as both FWS application and it should be fine.
